Water: no state permit to drill a well — a licensed driller, required by law for any well, files the paperwork with ADEM, and a household will never approach the 100,000-gallon-a-day threshold that triggers a Certificate of Use under the state Water Resources Act. Rainwater harvesting for personal use needs no state permit either. Combine that with sun that barely dips in winter and this is one of the more overlooked entries in the Southeast.

The Sun You Actually Get — and Why December Isn't the Problem
"Peak sun hours" (PSH) is the number that sizes an array — the equivalent hours per day of full 1,000 W/m² sun once cloud and season are baked in. Alabama's annual average runs roughly 4.5–5.2 depending on where in the state you stand, and unlike the northern half of the country, December gives up only about a quarter of that, not half. That's the real Alabama sun story: the array doesn't need a separate winter and summer design, because the two aren't far enough apart to force the choice. Rule of thumb: array kW ≈ daily load (kWh) ÷ (peak sun hours × 0.78) — the 0.78 covers inverter loss, wiring, temperature derate and soiling.

*Sized on the December row; because Alabama's winter dip is mild, most installers size straight to the December number rather than splitting the difference with generator hours — the array in the table is close to the right-sized, year-round system, not an emergency-only build. The trade runs the other way in summer: hot panels lose a few percent of rated output per degree above 25 °C, so real July and August production runs a little under the nameplate number even on a cloudless day.
What's Actually Regulated Here (Shorter List Than You'd Think)
The permitting question in Alabama is county-by-county, but the pattern holds:
- Inside a city, or a county that has adopted a code? Then the applicable residential code applies and you pull permits like anywhere else — the Alabama Energy and Residential Codes Board sets what that code has to be if a city or county chooses to enforce one at all.
- Rural unincorporated county with no building department? Common across the state — Geneva County, for one, enforces no zoning or building regulations in its unincorporated area and issues no certificates of occupancy. The rules change at the county line, so check the specific county, not the state.
- Building it yourself? Alabama's Home Builders Licensure Law exempts an owner who acts as their own contractor and does the supervision personally, on a one- or two-family home built for their own occupancy and not sold within a year (Alabama Code Section 34-14A-6). It waives the license, not any local permit that still applies where a building department exists.
- The 2027 change. Beginning January 1, 2027, licensed "residential home builders" — the people you'd hire, not an exempt owner-builder — have to build to Alabama's first-ever mandatory statewide residential code (Act 2024-443). It doesn't create a permit office in a county that has none, and it doesn't touch the owner-builder exemption above.
- Water, septic and the coast. No state permit to drill your own well — the licensed driller files the paperwork with ADEM. Septic is close to a true statewide constant, permitted through your county health department everywhere. The real regional exception: Baldwin and Mobile counties mandate hurricane-rated construction — wind-borne-debris protection and roofing rated up to 140 mph at the coast — regardless of how the rest of the county handles permitting.

Alabama Administrative Code Rule 420-3-1-.05
The rule that actually gates an off-grid build in Alabama isn’t a building code — it’s the state’s onsite sewage rule, and it applies whether or not the county you’re building in enforces any building code at all. Alabama Administrative Code Rule 420-3-1-.05, issued by the State Board of Health under Code of Ala. 1975 §22-26-1 et seq., bars anyone from occupying, renting, leasing or selling a building as a dwelling unless it is “provided with an approved sewage disposal system.”
In practice that means a permit application to the county health department — LHD in the rule’s own shorthand, for local health department — before the building goes up, not after. The LHD (or ADPH directly, in some cases) evaluates the lot itself: soil conditions, site layout and the daily sewage flow the household will generate decide what kind of system the parcel can support and how large it has to be. The rule doesn’t carve out an exemption for size, remoteness or off-grid status — a cabin on ten acres with no utility hookups still needs an approved system before anyone can legally live in it, and alternative setups like composting or incinerating toilets are handled elsewhere in the same chapter as approved system types, not as a way around the requirement.
The consequence people get wrong: picking a rural county specifically because it has no zoning or building department — Geneva County, cited above, is the documented example — doesn’t touch this rule. Septic runs on its own statewide track through the county health department, separate from whatever the county does or doesn’t enforce on construction, and it’s the one approval a genuinely off-grid, no-permit county still requires before you can occupy the place.

The Real Alabama Angle: Storms, Sparse Co-op Lines and a Code Clock Set for 2027
Alabama's grid, like North Dakota's, isn't fundamentally broken — Alabama Power and the state's 22 electric cooperatives keep the lights on most of the year. What's different here is exposure and reach. Exposure: the April 27, 2011 Super Outbreak put 62 tornadoes on the ground across Alabama in a single day, the most ever recorded in the state, and knocked out power to more than 670,000 Alabama Power customers — nearly half its base. Hurricane Sally cut power to roughly three-quarters of Mobile-area customers at its peak in September 2020, with most restored inside four days. Neither is a one-off. Reach: Alabama's cooperatives cover about 70% of the state's land on lines averaging roughly seven customers per mile, against Alabama Power's 18 — sparse enough that a rural parcel can sit a genuinely expensive extension from the nearest pole.
