Nevada hands you the easiest solar design in the lower 48 and the hardest water question. In December, when an array in most of the country is giving back half what it made in June, a south-facing array outside Las Vegas still turns in about 4.5 peak sun hours a day. Land is cheap by the acre too, at $1,200 against a national average of $4,350. The complication is underneath. Four fifths of the state is federal ground that will never be listed, and the water below the rest gets administered basin by basin by a State Engineer with the power to limit how deep you drill, or to refuse the well outright.

Why Nevada Is Cheap Land With an Expensive Question Attached
Three things stack here. Land: USDA NASS's 2025 survey puts Nevada farm real estate at $1,200 an acre, up 4.3% on the year, with pasture at $850 and cropland at $3,030 — among the lowest in the Mountain region. The squeeze is supply. The Congressional Research Service puts federal ownership at 80.1% of Nevada's 70.3 million acres, the highest share of any state, with the Bureau of Land Management alone administering 47.3 million. Cheap acreage with very little on the market is why listings cluster so hard around the few private corridors. Law: NRS 278.580 leaves building codes to cities and counties, which may adopt one, and NRS 278.582 openly contemplates a county that has none. In practice Nevada's rural counties do run a code office — Esmeralda and Eureka, two of the emptiest in the country, both have one — so the no-permit county isn't the Nevada play. Water: a domestic well drawing under 2 acre-feet a year needs no appropriation permit under NRS 534.180, and NRS 534.013 stretches "domestic use" to cover the garden, the lawn, livestock and pets. The Sun You Actually Get — and How Far December Falls
"Peak sun hours" (PSH) is the number that sizes an array — the equivalent hours per day of full 1,000 W/m² sun once cloud, season and tilt are baked in. Nevada's annual average runs roughly 5.5 to 6.5 on a south-facing array tilted at latitude, elite by national standards. What varies is December: the Mojave keeps about 70% of its annual average through the shortest weeks, the high desert around Elko closer to 55%. Rule of thumb: array kW ≈ daily load (kWh) ÷ (peak sun hours × 0.78) — the 0.78 covers inverter loss, wiring, temperature derate and soiling.

In the south that array is close to a right-sized year-round system, which is why Mojave builds so often skip the generator; from Reno north, December sits far enough below the annual number that most installers pair a summer-rational array with generator hours through the shortest weeks. Two Nevada derates cut the other way: panels lose a few percent of rated output per degree above 25 °C, and dust earns a wash schedule.
What's Actually Regulated Here (More Than the Forums Suggest)
The permitting question in Nevada is county-by-county on paper and fairly consistent in practice:
- Building code. NRS 278.580 gives any city or county the power to adopt a building code and set permit fees. No statewide residential code binds private construction, but adoption is close to universal, so plan on pulling a permit and ask which edition the county enforces.
- What the state does mandate. Every governing body has to amend its building code to permit systems using solar or wind energy that meet the code's rules on design, location and soundness (NRS 278.580(4)(b)) — your array is protected by statute — and to fold in the seismic provisions of the International Building Code (NRS 278.580(6)) in one of the country's most seismically active states. Plumbing is a separate statewide floor: under NRS 444.350 any construction or change of use must meet the Uniform Plumbing Code, code office or no code office.
- Building it yourself. NRS 624.031(5) exempts an owner building a residential structure for their own occupancy, unsold and unleased, from the contractor licensing law. Nevada adds a step most states don't: NAC 624.015 requires an Owner-Builder Disclosure Statement filed with the State Contractors Board and with the building official who will issue your permit. If the Board doesn't deny it within 10 days, it's deemed approved.
- Septic comes first. Under NAC 444.784, approval to construct an individual sewage disposal system must be obtained before any building permit is issued for a structure that needs one. NAC 444.790 sets a one-acre minimum lot area where the lot is served by a well, and NAC 444.796 puts the percolation testing on the property owner — two holes minimum.

Nevada Revised Statutes § 534.120
This is the real off-grid gate in Nevada, and it has nothing to do with the building code. On its face the state is generous about wells: NRS 534.180 says the groundwater chapter doesn’t apply to obtaining a permit for a well used for domestic purposes where the draught stays under 2 acre-feet a year, and NRS 534.013 defines those purposes broadly enough to include watering a family garden and lawn, livestock and household pets. That is the Nevada that shows up in off-grid forums.
NRS 534.120 is the other half. Inside a basin the State Engineer has designated under NRS 534.030 — the designation that follows when permitted rights approach or exceed what the basin recharges — he may make whatever rules and orders he deems essential for the welfare of the area. Subsection 4 spells out the powers: deny applications to appropriate groundwater where a water district or municipality already serves, limit the depth of domestic wells, prohibit the drilling of wells for domestic use where a public entity can furnish the water, and require water rights to be dedicated or relinquished before a parcel map with a domestic well on it gets approved. The exemption in NRS 534.180 removes the permit requirement. It removes none of that.
Two more edges matter before you buy. A domestic well drilled on or after July 1, 1981 can be ordered plugged, no sooner than a year after a political subdivision or regulated utility can furnish water to the site, if the well sits within 1,250 feet of a municipal system (NRS 534.180(3)). And where the State Engineer restricts withdrawals to conform to priority rights, NRS 534.110(9) floors a domestic well at 0.5 acre-feet a year on a meter — a quarter of the exempt allowance. That machinery gets used. Order 1264, dated August 25, 2015, designated the Diamond Valley Hydrographic Basin in Eureka County the state's first critical management area, finding pumping had exceeded the basin's 30,000 acre-foot perennial yield since at least 1975 and water levels under the farms had fallen more than a hundred feet since 1960.
The consequence people get wrong: treating the 2-acre-foot exemption as a guarantee that any Nevada parcel can have a well. On genuinely remote land, where no public entity can reach you, it usually amounts to one. On the semi-rural fringe outside Reno, Fallon, Pahrump or Las Vegas, in a basin both designated and within reach of a municipal system, the same statute lets the State Engineer limit or refuse it. Ask the Division of Water Resources which hydrographic basin the parcel sits in, and what orders are live on it, before you sign.

Southern Nevada builds in the lower half of every band. A December that still delivers 4.5 peak sun hours means less battery autonomy, no generator on most designs, and no snow-load or cold-rated hardware. From Reno north the same house lands in the upper half. December at 3.0 to 3.5 peak sun hours means a much larger array or a generator and more battery days, snow load and steeper racking get engineered in, and the acreage that makes Nevada affordable puts the array, the well pump and the house far enough apart that wire runs stop being a rounding error.

The Real Nevada Angle: Fire Season and a Grid That Now Switches Itself Off
Nevada's grid isn't fragile the way a hurricane-coast grid is fragile. What changed here is deliberate. NRS 704.7983 makes every electric utility file a natural disaster protection plan with the Public Utilities Commission of Nevada every third year, and that plan has to propose protocols for de-energizing distribution lines ahead of a fire. Those protocols get used. On November 20, 2024, NV Energy ran a Public Safety Outage Management event across seven northern Nevada zones — Genoa North, south Carson City, Virginia City Highlands, Galena, Washoe Valley and southwest Reno among them — cutting power to more than 15,000 customers ahead of forecast wind and fire danger.
The unplanned outages tell the same story from the other side. The Davis Fire started south of Reno on September 7, 2024; by the joint county and federal news release of September 9, peak outages had hit 17,000 NV Energy customers, with 3,116 still dark and powerline infrastructure damaged. On November 5, 2025, a windstorm with valley gusts to 65 mph and ridgetop gusts to 110 mph knocked out 28,258 customers across Washoe County. Add the distances, and the case for a stand-alone system rests on two things at once: what the utility does on a red-flag afternoon, and what it would cost to reach you at all.
Do I need a building permit for an off-grid home in Nevada?
Almost certainly yes. NRS 278.580 leaves code adoption to cities and counties rather than the state, but adoption is close to universal — even Nevada's least populated counties run a code office — so treat a permit as the default and confirm the edition with the county. Building it yourself, NRS 624.031(5) waives the contractor's license for an owner building for their own occupancy, and NAC 624.015 requires an Owner-Builder Disclosure Statement filed with the State Contractors Board and your building official.
Can I drill a domestic well on my Nevada land without a permit?
Under NRS 534.180 a well for domestic purposes drawing no more than 2 acre-feet a year needs no appropriation permit, and NRS 534.013 lets that cover a garden, lawn, livestock and pets. The catch is NRS 534.120: inside a groundwater basin the State Engineer has designated as depleted, he can limit the depth of domestic wells, prohibit new ones where a public entity can furnish water, and require water rights to be dedicated at parcel-map approval. Check the basin status with the Division of Water Resources before you buy.
Is there enough sun in Nevada for off-grid solar?
More than almost anywhere. On a south-facing array tilted at latitude, annual peak sun hours run roughly 5.5 in the north to 6.5 in the Mojave. December separates the two halves of the state: about 4.5 hours a day around Las Vegas and Pahrump, against 3.0 to 3.2 around Elko and Winnemucca. In the south the December-sized array is close to a sensible year-round system with no generator. In the north it means a bigger array, or a generator carrying the shortest weeks.
Can I collect rainwater in Nevada?
Yes, within limits. NRS 533.027 puts the de minimis collection of precipitation from the rooftop of a single-family dwelling outside the state's water appropriation chapter entirely, provided the use is nonpotable and domestic. That's narrower than it sounds: it covers roof runoff for household and outdoor nonpotable use only. In a state averaging under ten inches of rain a year, treat harvesting as a supplement and build the water plan around the well.
None of this changes whether off-grid makes sense on your specific parcel — it changes the order you check things in. Get the hydrographic basin and its live orders from the Division of Water Resources before you commit to land, start septic approval early because the building permit waits on it, and price the array against your region's December number rather than Nevada's headline annual one.
