The Sun You Actually Get — Sized for December, Not July
"Peak sun hours" (PSH) is the number that sizes an array — the equivalent hours per day of full 1,000 W/m² sun once cloud and season are baked in. Maine's annual average is workable but unremarkable — roughly 4.2–4.7 depending on where you stand, in the bottom half of US states — and the annual figure is the wrong number to size on here, because December delivers less than half of it. An off-grid system that has to stand alone in midwinter gets sized on the December row, with a generator carrying the darkest stretch. Rule of thumb: array kW ≈ daily load (kWh) ÷ (peak sun hours × 0.78) — the 0.78 covers inverter loss, wiring, temperature derate and soiling.

*Sized on the December row with steep-tilt racking; in practice nobody builds the full winter array — a right-sized system pairs a summer-rational array with generator hours through December and January, which is exactly the trade an installer should be quoting you. One real compensation: cold, clear air makes a panel run more efficiently per hour of sun than the same panel in summer heat, and steep racking sheds snow instead of burying itself under it — the flip side is coastal fog, which is Portland and Brunswick's real tax on summer production that Aroostook County mostly avoids.
What's Actually Regulated Here (Not Where You'd Guess)
The permitting question in Maine comes down to which authority actually covers your land, not just how rural it feels, and the pattern is consistent:
- Municipality over 4,000 people, or a smaller town that opted in? The Maine Uniform Building and Energy Code (MUBEC, currently the 2021 IRC for residential work) applies, and you pull a permit like anywhere else. Towns of 4,000 or fewer aren't required to enforce any building code — but a town that does enforce one is stuck with MUBEC by state law; it can't swap in a homemade version.
- In the unorganized territory? That's not a gap in the rules. Roughly 10.4 million acres of Maine has no town government at all, and it's easy to assume that means no permit — it doesn't. The Land Use Planning Commission (LUPC) is the zoning and permitting authority out there, and its own building permit application says plainly that no construction may begin before you've received one.
- Electrical is the statewide exception. Wiring is regulated everywhere in Maine through the Electricians' Examining Board or a town's own electrical inspector (Title 32 §1102-C) — a permit and inspection apply to a new off-grid installation even on land with no building code at all.
- Water and septic. A private domestic well needs no state water-right permit, but the site still needs Drinking Water Program approval before drilling, the work has to be done by a licensed well driller, and a completion report gets filed afterward. Septic runs through the state's Subsurface Wastewater Disposal Rules everywhere — a Local Plumbing Inspector, or LUPC's own reviewer in the unorganized territory, has to approve the system before you build.
- Floodplain. Municipalities that participate in the National Flood Insurance Program regulate new construction in mapped floodplains — worth checking specifically for river-bottom or coastal parcels.

Maine Title 10 §9724
This is the actual switch that turns Maine's building code on or off for a given piece of land. Subsection 1 sets the trigger in one sentence: the Maine Uniform Building and Energy Code "must be enforced in a municipality that has more than 4,000 residents." No town vote required, no opt-out once you're over that line. Subsection 1-A covers everyone else — a municipality of 4,000 residents or fewer isn't required to enforce any building code at all, but if it chooses to enforce one, the only options are MUBEC itself or its building-only and energy-only halves. A small town can opt in; it can't write its own code instead.
For someone actually buying land and building off-grid, the section answers the permit question in order: does your town cross 4,000 residents on its own count, not the county's; if it doesn't, has that specific town separately voted to adopt a code anyway (most rural Maine towns haven't); and if a code does apply, the application goes to the town's own code enforcement officer, not a state agency, before framing starts. Cross the threshold and you're the applicant — there's no off-grid carve-out for a house that won't be tied to a utility.
The detail buried further down in the same section, in subsection 5, is the one people miss: even in a town where MUBEC fully applies, its construction requirements do not reach log homes, post-and-beam or timber-frame construction, or warehouses and silos built to store harvested crops — those are named exemptions from the code itself. That covers a fair share of owner-built off-grid homes. What it doesn't do is exempt the build from the town's permit process or from the separate electrical, well and septic rules covered above — the exemption is from MUBEC's construction requirements specifically, not a blanket pass out of every rule that touches the property.
