Hawaii inverts the usual off-grid arithmetic. On the mainland the grid is the cheap default and independence is the premium; here residential customers paid 52.0 cents a kilowatt-hour in May 2026 against a national average of 18.4, so the bill you're trying to walk away from is close to three times what a mainland buyer prices against. The sun cooperates as well, and season has little to do with it — December on most Hawaii parcels runs only a fifth to a quarter below the annual average. What the state charges in exchange is paperwork and freight. Every acre sits inside one of four county building departments, and the state sewage rule that decides whether you can legally occupy the house takes no interest in how remote the lot is.

Why Hawaii Reads Off-Grid and Regulates Like a City
Three things stack here, and none of them behaves the way the mainland states do. Land: the 2022 Census of Agriculture put the average market value of Hawaii farm land and buildings at $11,411 an acre, up from $9,328 in 2017, against a national cropland average of $5,830 an acre in 2025. Acreage is the expensive input here, and the cheapest of it sits in the volcanic hazard zones for a reason. Law: there is no county-level opt-out anywhere in Hawaii. The State Building Code Council adopts state codes under HRS chapter 107 — currently the 2018 IRC, IBC, IECC, IEBC and Uniform Plumbing Code, the 2018 National Electrical Code and the 2024 state fire code — and the four counties amend and adopt them locally, with a two-year default deadline under HRS section 107-28. Hawaii County, which holds most of the state's rural land, runs its residential code on the 2018 IRC. Water: a well needs a construction permit from the Commission on Water Resource Management anywhere in the state, while rainwater catchment is legal, ordinary and unregulated for a private household.

The Sun You Actually Get — Geography Beats Season Here
“Peak sun hours” (PSH) is the number that sizes an array — the equivalent hours per day of full 1,000 W/m² sun once cloud and season are baked in. At Hawaii's latitude the winter dip is mild, roughly 20 to 25 percent below the annual mean, the smallest seasonal swing in this series. What matters instead is where on the island you stand: windward slopes sit under trade-wind cloud much of the year, while a leeward parcel twenty miles away collects a quarter more sun annually. Rule of thumb: array kW ≈ daily load (kWh) ÷ (peak sun hours × 0.78) — the 0.78 covers inverter loss, wiring, temperature derate and soiling.

*Long-term average horizontal irradiation from the Global Solar Atlas (Solargis model), converted to daily peak sun hours and sized on the December row; a tilted array recovers a little of the winter figure. Kona's leeward row reads oddly until you know the pattern: daily sea-breeze cloud costs it more in summer than in December. The spread between Puna and Waikoloa is around 27 percent on the annual number, far larger than anything the calendar does to either, so the site survey earns more here than the seasonal design does. December is also the wet season on the windward side, and the weather that costs you array output fills the catchment tank.
What's Actually Regulated Here (All of It, by Four Counties)
Hawaii has no county without a building department, so the permitting question is which county rather than whether:
- A permit applies everywhere. Honolulu, Hawaii, Maui and Kauai counties each run a building division working from the state codes as amended locally. Nothing here resembles a rural no-code county on the mainland.
- Building it yourself is allowed, with conditions. HRS section 444-2.5 exempts an owner or lessee who builds for their own use and doesn't offer the result for sale or lease, provided they register the exemption with the county under section 444-9.1. Selling or leasing within a year of completion is prima facie evidence the build was for sale, and the exemption expressly does not cover electrical or plumbing work, which has to be done by a contractor licensed under HRS chapter 448E — on an off-grid property, the entire power system.
- Wells need a state permit; catchment doesn't. No well may be constructed and no pump installed without a permit from the Commission on Water Resource Management, required for all areas of the state (HAR section 13-168-12). Roof catchment for a private home needs no state permit and is how tens of thousands of residents already get their water, with treatment left to the owner.
- Volcanic hazard is a real line item. The USGS lava-flow hazard zones rank the Island of Hawaii from 1 to 9. Zone 1 covers the summits and rift zones of Kilauea and Mauna Loa; Zone 2, immediately downslope, has had 15 to 25 percent of its area covered by lava since 1800. That map, more than any zoning ordinance, sets insurance availability, financing and price on the cheapest land in the state.

Hawaii Administrative Rules Section 11-62-31.1
The rule that actually gates an off-grid dwelling in Hawaii is the Department of Health's wastewater rule, and it applies identically across all four counties. Section 11-62-31.1 of Title 11, Hawaii Administrative Rules, governs individual wastewater systems — the on-site septic or aerobic system every property off a county sewer needs. Subsection (d) is the sentence that reshaped rural building here: “No cesspool shall be used as the wastewater system by any new building. No new cesspools shall be constructed after the effective date of this rule…” That date is March 21, 2016.
The rest of the section sets the geometry and the approval. There must be 10,000 square feet of land area for each system, and the lot itself may not be smaller than 10,000 square feet, except for lots recorded before August 30, 1991, which are limited to one system. Flow into a single system is capped at 1,000 gallons and five bedrooms. Subsection (f) is unambiguous about who decides: “No person shall use an individual wastewater system until authorized in writing by the director.” In practice a Hawaii-licensed civil engineer runs a percolation test and site survey, designs the system and submits plans to the Wastewater Branch; a licensed contractor installs it; the engineer files a final inspection report; and only then does the written approval issue. A county building permit for a dwelling with no sewer connection moves through that approval, so the septic design is the long pole on a Hawaii build far more often than the array is.
The consequence people get wrong: assuming that because every neighbor on a 1970s subdivision road is on a cesspool, a cheap cesspool is the rural default. It stopped being legal for new construction in 2016. The state counts roughly 88,000 cesspools, nearly 50,000 on Hawaii Island, releasing about 53 million gallons of untreated sewage into the ground daily, and Act 125 of 2017 requires every one converted or connected to a sewer by 2050. Composting and incinerating toilets are approved technologies rather than an exemption: they handle toilet waste only, and the shower, laundry and kitchen water still needs an approved system.

The Real Hawaii Angle: 52-Cent Power on Islands That Can't Borrow a Line Crew
Every island in Hawaii is its own electrical system, with no interconnection between them and no mutual-aid convoy driving in from the next state, which is why the outage record reads the way it does. Hurricane Iniki put its eye over Kauai on September 11, 1992, with 145 mph sustained winds and gusts recorded to 227; power went out across the island at 1:20 that afternoon, roughly 5,000 utility poles came down, and restoration took more than two months. On October 15, 2006, the magnitude 6.7 Kiholo Bay earthquake tripped generation on Oahu into an island-wide blackout affecting about 291,000 Hawaiian Electric customers, some dark for 14 hours. On May 3, 2018, Kilauea's lower East Rift Zone eruption forced the Puna Geothermal Venture plant offline ahead of the lava — 38 MW that had supplied about 29 percent of the island's generation the previous year — and lava went on to bury two capped wells, a substation and a warehouse. On July 6, 2025, Hawaiian Electric ran the first public safety power shutoff in its history, de-energizing about 330 Upcountry Maui customers in high fire-danger wind.
The utilities are spending against all of this: Hawaiian Electric puts more than $100 million a year into resiliency work, trimmed vegetation along 2,334 miles of circuits in 2025, installed fire-detection cameras at 144 locations, and keeps a 45-day fuel reserve because the fuel arrives by ship. A mainland grid recovers by trucking in people and parts; a Hawaii grid recovers at the speed of a harbor. Against 52-cent power and a supply chain one storm can pause, a battery-backed stand-alone system stops looking like a lifestyle decision.
Do I need a building permit for an off-grid home in Hawaii?
Yes, everywhere. All four counties — Honolulu, Hawaii, Maui and Kauai — run building divisions working from the state codes adopted under HRS chapter 107, and no part of the state sits outside one. You can act as your own general contractor under the owner-builder exemption in HRS section 444-2.5, provided you register it with the county under section 444-9.1 and don't sell or lease within a year of completion. The exemption stops at electrical and plumbing work, which must be done by contractors licensed under HRS chapter 448E — on an off-grid property that covers the whole power system.
Can I put in a cesspool or use a composting toilet instead of septic?

Is rainwater catchment legal, and can I skip drilling a well?
Catchment is legal, common and unregulated for a private household — the University of Hawaii's extension service estimates 30,000 to 60,000 people already rely on it. Wells are the regulated path: none may be constructed anywhere in the state without a permit from the Commission on Water Resource Management under HAR section 13-168-12. On a wet windward parcel a catchment system is straightforward; on a leeward lot the tank has to carry longer dry stretches, and treatment is on the owner.
Is there enough sun in Hawaii for off-grid solar?
Yes, and the December penalty is the smallest in this series — roughly 20 to 25 percent below the annual average, against the half you'd give up in the northern states. Location does the damage instead. A parcel in Puna averages around 4.8 peak sun hours a day while South Kohala runs near 5.7, a 27 percent gap on the same island. Size on the December figure for your own site, because on Hawaii Island the island-wide average describes almost nobody.
None of this changes whether off-grid makes sense on your specific parcel — it changes what to check before you sign anything. Answer the wastewater question first, since the engineered system and the Department of Health approval set the schedule for everything else; check the lava-flow hazard zone before you fall for the price; and size the array on the real December number for your side of the island.
