What's Actually Regulated Here (More Consistent Than a Jurisdiction Lottery)
Iowa's permitting picture doesn't hinge on which township happened to opt in — the pattern is more uniform county to county:
- The energy code is the one mandatory statewide piece. Iowa Code chapter 103A makes the state's energy-conservation requirements apply to construction statewide. Beyond that, adopting the rest of the building code — the structural and life-safety provisions — is a local option: a city or county can adopt it, adopt part of it, or adopt none of it, and plenty of rural Iowa acreage sits in a county that hasn't.
- Every new well needs a permit — there's no small-homestead exemption. Iowa requires a private well construction permit for a household well regardless of how little water you'll use. Your county issues it by default through the state's Iowa Well Information System (IWIS), and the drilling itself has to be done by a DNR-certified well contractor on site.
- The water-use permit is a separate, much higher bar. A water-use (appropriation) permit only kicks in above 25,000 gallons a day — a threshold no household well will ever approach — so in practice the construction permit above is the only water paperwork a homestead sees.
- Septic is a county permit under a statewide minimum standard. Private sewage disposal systems serving a single home are permitted and inspected by your county's environmental health department under Iowa's Chapter 69 rules, and the state layers on one more universal rule: a certified time-of-transfer inspection whenever a property with a septic system changes hands.
- Zoning and floodplain rules sit outside the building code entirely. The mistake people carry over from states with a small-well exemption is assuming a single household tap is too minor to need paperwork, because Iowa also has a 25,000-gallon-a-day threshold before a separate water withdrawal permit applies. That number governs how much water you can draw, not whether you can put a well in the ground — a homestead well pulling a fraction of that figure still needs the 49.4(2) construction permit from the county before the first foot of casing goes in.
