What's Actually Regulated Here (Longer List Than Some States on This List)
Virginia is the anti-loophole state in this series — the pattern is consistent and it applies almost everywhere:
- Building permit — mandatory statewide, no local opt-out. Every locality enforces the same Uniform Statewide Building Code; it supersedes any local code, and no county, township or independent city can decline to enforce it. A rural parcel gets the same plan review, permit and inspection sequence as a subdivision lot.
- The farm-building exemption is narrow. The one real carve-out covers structures on an operating farm — barns, equipment sheds, animal shelters, farm-business offices. It does not cover your house, and even an exempt farm structure inside a mapped floodplain or mudslide-prone area still answers to flood-proofing regulations.
- Electrical isn't a separate escape hatch. Wiring for an off-grid system — inverter, disconnects, panel — is part of the same USBC permit and inspection as the rest of the build, not a lighter-touch parallel process.
- Wells and septic both run through the local health department. A private well needs a construction permit for essentially every new well, drilled by a state-licensed Water Well System Provider — no acreage or gallon exemption. Septic needs a state-licensed Authorized Onsite Soil Evaluator to test the site before the health department will issue the permit.
- Rainwater harvesting splits on potable versus non-potable. Systems for irrigation, toilets or hose bibs need no state permit. A system built for drinking water needs a Virginia Dept. of Health permit under regulations that only took effect October 21, 2024.

Code of Virginia §36-98
§36-98 is the statute that actually creates Virginia's no-opt-out building code. It directs the Board of Housing and Community Development to adopt the Uniform Statewide Building Code and states that the Code "shall supersede the building codes and regulations of the counties, municipalities and other political subdivisions and state agencies." The section carves out a short list of exceptions — other state agencies' rules on public water supply, wastewater treatment and solid waste facilities stay in force, and a handful of local single-family ordinances covering foundations, specific materials or window counts survive only when they're tied to a proffered rezoning, a special permit, a cluster-development standard, an airport or highway overlay, a historic district, or National Flood Insurance Program floodplain rules. There is no exception in this section for rural parcels, unzoned counties or farm structures.
For someone building off-grid on rural land, this is the section that forecloses the county-by-county gamble that works in some other states on this list. It doesn't matter whether the county has zoning, whether the parcel is agricultural, or how far out the nearest inspector is based — the same statewide code applies everywhere, and it's the local building department, not the county board of supervisors, that reviews the plans, issues the permit and inspects the build under this section's companion enforcement statute, §36-105. A landowner applies to that local department, not to any state office, and no county, city or town in Virginia has declined to enforce the Code.
The mistake people repeat is treating "no zoning" or "unrestricted agricultural land" as the same thing as "no building code." They're separate systems in Virginia, and §36-98 supersedes local building regulation regardless of what local zoning does or doesn't require. A rural parcel with no zoning restrictions at all still goes through the same USBC permit and inspection sequence as a subdivision lot — the absence of zoning says nothing about whether a building permit is required.

The Grid-Strain Angle: A Reliable Grid Under New Pressure
