Land: statewide pastureland averaged about $1,556 an acre in 2026 (NDSU Extension's annual survey — the sixth straight yearly rise, and still among the lowest workable figures in the Lower 48), with cropland around $3,500. Law: North Dakota's State Building Code only applies where a city, county or township has elected to adopt and enforce it — outside the cities, many rural jurisdictions never have, which means no general building permit for the house or the array on a lot of open-country parcels. The Sun You Actually Get — Sized for December, Not June
"Peak sun hours" (PSH) is the number that sizes an array — the equivalent hours per day of full 1,000 W/m² sun once cloud and season are baked in. North Dakota's annual average is workable — roughly 4.3–4.8 depending on where you stand — but the annual average is the wrong number to size with here, because December delivers barely half of it. An off-grid system that has to stand alone in midwinter gets sized on the December row, with a generator or wind turbine carrying the worst stretches. Rule of thumb: array kW ≈ daily load (kWh) ÷ (peak sun hours × 0.78) — the 0.78 covers inverter loss, wiring, temperature derate and soiling.

What's Actually Regulated Here (Shorter List Than You'd Think)
The permitting question in North Dakota is jurisdiction-by-jurisdiction, but the pattern is consistent:
- Inside a city or a jurisdiction that adopted the code? Then the State Building Code (2021 I-Codes as adopted) applies and you pull permits like anywhere else. If a local government enforces any building code, state law says it must be this one.
- Rural township or county that never adopted a code? Common on open-country land — there is no general building permit to pull for the house or the ground-mount array. Check the county first, then the township: either can have opted in, and zoning (setbacks, minimum parcel size) can exist even where building codes don't.
- Electrical is the statewide exception. Wiring is regulated by the North Dakota State Electrical Board everywhere in the state — a wiring certificate and inspection apply to a new off-grid installation even on land with no building code. Budget for it; it's also the inspection that catches the mistakes that burn cabins down.
- Water and septic. No state permit for a domestic well under 12.5 acre-ft/yr, but the drilling itself must be done by a state-licensed water well contractor who files a driller's report within 30 days. Septic runs through your district health unit — plan on that permit and inspection statewide.
- Floodplain. Counties in the National Flood Insurance Program regulate structures in mapped floodplains — a real consideration in the Red River Valley specifically.

North Dakota Century Code § 43-09-09
Century Code § 43-09-09 is the actual gate here, and it is stricter than most people assume: a person may not plan, lay out, supervise, install, alter, or repair wiring for electric light, heat, or power — on or off the grid — “unless licensed by the board,” the State Electrical Board created under Chapter 43-09. Nothing in that sentence is conditioned on being tied to a utility, inside city limits, or on a parcel where the county or township has adopted a building code. It governs the wire itself.
The trigger that makes it real is § 43-09-05: once any electrical wiring or power-limited system installation reaches five hundred dollars in value, a board-appointed inspector must inspect it and either approve or condemn it. Almost any off-grid array, inverter, and battery bank clears that number many times over. Section 43-09-16 lists who is exempt from licensing — utility linemen, telecom and cable crews, appliance techs connecting to an existing receptacle, and a few narrow low-voltage cases — and a homeowner wiring their own off-grid system is not on that list.
That is the practical consequence people get wrong: North Dakota lets you dig your own well, design your own septic layout, and, on unincorporated land, build the structure itself with no permit at all — but it does not extend that same do-it-yourself latitude to the panel and wiring. That work has to go through a licensed electrician, and the state does make it workable for rural property: a Class B electrician, the lighter license (eighteen months of farmstead or residential wiring experience plus an exam), is specifically authorized under § 43-09-20 to contract for farmstead wiring, or for residential wiring in a one- or two-family home in a city of twenty-five hundred people or fewer — which covers the great majority of North Dakota off-grid builds without requiring a full master electrician.
