The Sun You Actually Get — and Why December Barely Moves the Needle
"Peak sun hours" (PSH) is the number that sizes an array — the equivalent hours per day of full 1,000 W/m² sun once cloud and season are baked in. What's Actually Regulated in Arizona (It Changes at the County Line)
There's no single statewide answer here — it's a county-by-county, and sometimes zone-by-zone, picture:
- No statewide mandatory building code. Arizona has no single code enforced by one agency — every city and county adopts (or doesn't adopt) its own version of the model ICC codes and enforces it through its own building-safety department. State law also lets a county board exempt land zoned rural or unclassified from whatever code that county has adopted, so a meaningful share of raw desert acreage carries no general building-permit requirement for the house at all. Confirm current zoning and code status directly with the county's development-services office before you assume either way — it's not a blanket rule and it can differ by zoning district within the same county.
- Domestic wells are a statewide exemption, with real paperwork. A well pumping 35 gallons a minute or less for household use is an "exempt well" under Arizona water law — no water right and no usage reporting required — but you still file a Notice of Intent to Drill with the Arizona Department of Water Resources before the rig shows up, and the well has to be drilled by a state-licensed contractor. The filing fee is $100 outside an Active Management Area, $150 inside one.
- Septic is close to universal. The Arizona Department of Environmental Quality sets the standard but delegates permitting and inspection to your county's health or environmental department — expect a site (percolation) evaluation and a permit before you can install, in essentially every county.
- Floodplain rules apply even without a building code. County flood control districts regulate construction in mapped Special Flood Hazard Areas as a condition of the county's participation in the National Flood Insurance Program — a real check on wash-adjacent and floodplain-mapped parcels regardless of whether the county otherwise requires a general building permit.
- Electrical work has its own statewide licensing floor. Once a job's labor and materials pass $1,000, or it needs a local permit, Arizona law requires whoever does the electrical work for pay to hold an Arizona Registrar of Contractors license — that licensing requirement doesn't depend on whether your county has adopted a building code, even though the inspection itself does.

Arizona Revised Statutes § 11-861
This is the actual statute behind the county-by-county building-code picture described above. It doesn't create a state building code — it authorizes the board of supervisors of any county that has adopted zoning to adopt and enforce a building code for that county's unincorporated, zoned areas, and in the same sentence gives that board a carve-out: it "may authorize that areas zoned rural or unclassified may be exempt from the provisions of the code adopted." Whether a county has zoning at all, whether its board has adopted a code under this section, and whether it has used the rural/unclassified exemption are three separate, county-level decisions — the statute sets what a county is allowed to do, not the answer for any one parcel.
For someone buying rural land to build off-grid, § 11-861 is the section that ultimately decides whether the house itself needs a building permit and inspection at all. The exemption isn't self-executing from the text — it only exists in a given county if that county's board has both adopted a code under this authority and chosen to apply the rural/unclassified carve-out. That makes the county's development-services or planning department the right first call, not the statute itself: the question to ask is whether the parcel's actual zoning classification is one the county has exempted, since the same county can apply its code to some zoning districts and exempt others.
The mistake buyers make is treating "rural" as a description of the land instead of a zoning designation. A parcel that looks and functions like open desert can still carry a zoning classification — agricultural or residential-estate, for example — that the county never exempted; only land actually zoned rural or unclassified on the county's own map qualifies under this section, regardless of how remote the parcel feels. And where the exemption does apply, it only reaches the building code itself — it doesn't touch the separate septic, floodplain or electrical-licensing rules covered above, which sit on their own statutory authority.

The Water Angle: Why Off-Grid in Arizona Starts With the Well, Not the Panels

That framework is a live fight, not a settled one: in June 2023, Governor Katie Hobbs directed the Department of Water Resources to pause new groundwater-reliant subdivision approvals across the Phoenix AMA after an updated model found the basin roughly 4.86 million acre-feet short of demand over the next century — a decision that froze parts of several planned developments on the Valley's outskirts. Home builders sued in January 2025, and in April 2026 a Maricopa County Superior Court judge ruled the specific rule ADWR used procedurally invalid, blocking its enforcement for now. None of that touches a single buyer drilling one exempt well on a rural parcel outside a subdivision — that rule hasn't changed since 1980 — but it shows how contested the state's water math is at the policy level. The sharper cautionary tale is Rio Verde Foothills: on January 1, 2023, the City of Scottsdale cut off the standpipe that more than a thousand unincorporated residents relied on for hauled water, and some residents were reduced to catching rainwater for indoor non-potable use while paying hundreds of dollars a month more for trucked deliveries. A permanent fix — EPCOR's own filling station, independent of Scottsdale's system — didn't open until January 1, 2026, three years later.
