North Carolina is the state in this series where the permit question has the same answer in all 100 counties. No rural county here runs without a building code, because state law puts the North Carolina State Building Code over every acre and splits enforcement between the cities and the counties with nothing left over. Why North Carolina Is a Strict-Code State With Forgiving Sun
Three things stack here, the same three that decide every state in this series. Land: North Carolina is expensive by regional standards, with USDA NASS putting farm real estate at $5,470 an acre for 2025, up 5.4% in a year, cropland at $5,360. The outlier is pasture at $6,050 an acre — more than cropland, and over three times the national pasture average of $1,920. Grass here is priced as land that could be something else. Law: § 143-138(e) puts the State Building Code over the whole state as each volume is adopted, and § 160D-1110 requires permits under it. Building your own house stays legal — § 87-1(b)(2) exempts an owner building on their own land for their own occupancy from the general contractor license, and that exemption covers the license alone. Water: every county must run a private drinking water well program through its health department under § 87-97(a), so a domestic well is permitted, inspected and tested by rules written in Raleigh.

The Sun You Actually Get — a December That Barely Moves
“Peak sun hours” (PSH) is the number that sizes an array — the equivalent hours per day of full 1,000 W/m² sun once cloud, season and tilt are baked in. North Carolina's yearly average sits between roughly 4.6 and 5.0 on a south-facing array tilted at latitude, and December holds about three quarters of that. The December spread is small: a mountain parcel near Murphy and a coastal one near Wilmington are half a peak sun hour apart. Terrain separates them in practice, because a satellite climatology sees a grid cell rather than the ridge sitting between your roof and the low winter sun. Rule of thumb: array kW ≈ daily load (kWh) ÷ (peak sun hours × 0.78) — the 0.78 covers inverter loss, wiring, temperature derate and soiling.

Because the winter dip here is a quarter rather than a half, most installers size straight to December instead of splitting the difference with generator hours, so the table is close to a right-sized system. Two things move a real site off these numbers: mountain terrain, where a south ridge or a north-facing cove costs more than latitude ever does, and summer heat, which takes a few percent off rated output.
What's Actually Regulated Here (Longer List Than You'd Like)
The permitting question has one answer statewide here, and sequence matters more than paperwork:
- A building permit is required everywhere. No unincorporated pocket of North Carolina sits outside a building-rules jurisdiction — cities cover their limits and extraterritorial areas, counties the rest, and § 160D-1110(a) requires permits before construction, plumbing, mechanical or electrical work begins.
- The $40,000 exclusion won't help an off-grid build. Work costing $40,000 or less in a single-family residence is exempt from permitting under § 160D-1110(c), with six carve-outs. One is any change in the design of electrical wiring, devices or equipment beyond like-kind swaps — exactly what an array, a battery bank and an inverter are. Off-grid electrical work is permitted and inspected regardless of price, by an electrician licensed under § 87-43.
- Owner-builders keep their exemption. Under § 87-1(b)(2) you can build on land you own without a general contractor license, provided the building is intended solely for your own occupancy and you comply with § 87-14. Occupancy of under 12 months raises a legal presumption that it never was. Permits and inspections still apply.
- Septic comes first, ahead of the building permit. Under § 130A-338, no permit for electrical, plumbing, heating, air conditioning or other construction may issue until a construction authorization has been issued for the wastewater system. The health department's chain runs improvement permit, construction authorization, then operation permit once the install is inspected (15A NCAC 18E .0201). A poor soil evaluation can end a purchase, which is why experienced buyers make the offer contingent on it.
- Wells are permitted, inspected and tested. Section 87-97 requires a construction permit from the county health department, a field investigation of the site before it issues, a certificate of completion before the well goes into service, and a water test within 30 days for arsenic, lead, nitrates, bacteria and a dozen other parameters.
- Rainwater is regulated where it enters the house. No permit attaches to the cistern itself under the state's well or wastewater rules. Plumbing it in is permitted work under § 160D-1110(a)(2), and 15A NCAC 18E .0201(a) still sends all wastewater from a building with water-using fixtures to an approved system.
- The coast adds a permit. Development inside an area of environmental concern needs a CAMA permit on top of every other state and local approval (§ 113A-118), which catches much of the eastern waterfront.

North Carolina General Statutes § 143-138(e)
This is the provision that decides how off-grid works in North Carolina, and the operative line is one sentence: “Except as otherwise provided in this section, the North Carolina State Building Code shall apply throughout the State, from the time of its adoption.” The Code runs to ten volumes, from Administrative Code and Policies through Electrical, Plumbing and Residential, adopted once at state level by the Building Code Council and the Residential Code Council under § 143-138(a).
The same subsection divides enforcement so nothing falls between the cracks. Municipal jurisdiction covers everything inside the corporate limits plus any extraterritorial area established under § 160D-202, and county jurisdiction “shall include all other areas of the county.” A county here cannot decline to run a building department the way Geneva County in Alabama or Saguache County in Colorado can, and what a local government may add is narrow: floodplain regulations, and a fire code the Council has to approve first.
Genuine exclusions exist, and they are worth knowing because people misread them. Section 143-138(b4) says building rules do not apply to farm buildings outside the building-rules jurisdiction of any municipality, to primitive farm buildings, or to a primitive camp — a structure tied to outdoor camping, no larger than 4,000 square feet, not intended to be occupied more than 24 consecutive hours. A farm building is defined as a nonresidential building used for a bona fide farm purpose. The barn and the hunting shelter can sit outside the Code; the house you intend to live in never does, whatever it is called on the plans.
The consequence people get wrong: shopping for a North Carolina county the way they'd shop for one in the Deep South or the Mountain West. Remoteness buys nothing here. What it buys instead is predictability — § 143-138(d) now limits the Residential Code Council to a comprehensive revision every six years, the first effective January 1, 2031, so a design that passes inspection in 2026 faces no wholesale rewrite for years.

What an Off-Grid Build Costs in North Carolina in 2026

Which half of each band you land in splits roughly along the fall line. Piedmont and Coastal Plain builds usually sit in the lower half: December sun close to the state's best, no snow-load engineering, level sites, and crews who can get a truck to the array position. Mountain builds usually sit in the upper half, and the reasons compound — steeper racking, ice and snow shedding, generator integration, long private drives that put the array a hundred yards from the panelboard, and slope work that turns a one-day mount into three. In all three classes, budget the permit set, the electrical inspection and the well and septic permits as their own line, because North Carolina charges for approvals several states in this series don't require.

The Real North Carolina Angle: Helene, Florence and Lines That Follow the Water
North Carolina's grid is competent and its exposure is extreme, and the two facts sit side by side. Hurricane Helene knocked out power to an estimated 1.18 million North Carolina customers between September 26 and 28, 2024, on the National Hurricane Center's count. The rainfall behind that number beat anything the state had records for: 30.78 inches at Busick in Yancey County, more than 2,000 landslides documented by the USGS with the majority in western North Carolina, and the French Broad at Asheville cresting at 24.8 feet against a 1916 record of 23.1. Florence had done something similar to the other end of the state six years earlier, cutting power to roughly one million North Carolina customers in September 2018.
What makes this more than statistics is where mountain distribution lines run. They follow the same creek drainages and road cuts that gave way in September 2024, which is why restoration in the western counties took weeks where a coastal storm takes days. The flip side deserves saying: a mountain slope is exposed to that terrain with or without a utility connection, and no battery bank saves a house from a debris flow. What independence buys is the ordinary version of the emergency — the week the road is passable and the crews are still four valleys away, with your own pump, freezer and lights running.
Do I need a building permit for an off-grid home in North Carolina?
Yes, everywhere. General Statutes § 143-138(e) applies the State Building Code throughout the state, with cities enforcing inside their limits and extraterritorial areas and counties enforcing the rest, so no county lacks a building-rules jurisdiction. Section 160D-1110 requires the permits, and its $40,000 minor-work exclusion won't rescue a solar build, because any change in the design of electrical wiring or equipment is a carve-out.
Can I drill a well on my own land without a permit?
No. Section 87-97 makes every county run a private drinking water well program through its health department, and a construction permit has to issue before drilling starts. The department investigates the site first, then inspects the finished well and issues the certificate of completion the well cannot legally operate without. Within 30 days the water is tested for arsenic, lead, nitrates, bacteria and more than a dozen other parameters.
Is there enough sun in North Carolina for off-grid solar?
Yes. A south-facing array at latitude tilt sees roughly 4.6 to 5.0 peak sun hours a year across the state, and December holds around 3.2 to 3.7 of that by region — a quarter down, where northern states give up half. The mountains sit at the bottom of that range, and terrain matters more than the map there: a ridge on your southern horizon costs more December output than the gap between Murphy and Wilmington.
Can I use a composting toilet instead of a septic system?
You can use one, and it doesn't replace the system. Rule 15A NCAC 18E .1001 allows composting, incinerating and mechanical toilets under the North Carolina Plumbing Code, then requires all other wastewater from the building to discharge to an approved wastewater system. Holding tanks are explicitly unacceptable for new construction under Rule .0201(f), and under § 130A-338 no building, electrical or plumbing permit issues until the wastewater construction authorization has been granted.
None of this changes whether off-grid makes sense on your parcel — it changes the order you do things in. Get the soil evaluation and the improvement permit moving first, because here they gate the building permit outright. Budget the electrical permit and inspection into the system price from the start. And size the array on the December number, using your actual southern horizon rather than the regional average.
