Off-Grid in Rhode Island: Land, Permits, Solar & Cost

Rhode Island is the hardest state in this series to do quietly. There is no unincorporated land to disappear into — every acre sits inside one of 39 cities and towns, and the state's permit-fee regulation publishes a building-permit schedule for all 39. Land is the most expensive in the country: USDA put Rhode Island farm real estate at $22,500 an acre in 2025, more than $5,000 clear of the next state. The sun is thin exactly when you need it, around 2.6 peak sun hours a day in December at latitude tilt. What the state gives back is a real reason to want batteries: average retail electricity ran 24.15 cents a kilowatt-hour in 2024, fourth-highest in the nation, and the storm track up Narragansett Bay has twice in fifteen years taken the lights off much of the state for days.

Why Rhode Island Is the Most Regulated Small State in This Series

Three things stack here, and none of them is loose. Land: USDA's 2025 Land Values summary put Rhode Island farm real estate at $22,500 an acre, pasture at $16,900 and cropland at $32,900 — the highest farm real estate figure of any state in the survey, up from $17,400 in 2021. Those are agricultural benchmarks, so a wooded lot in Foster or Exeter trades below them, though the direction is unmistakable. Law: one building code covers the state, promulgated centrally and enforced by the local building official in each of the 39 municipalities. Houses go up to the 2021 International Residential Code, wiring to the 2023 National Electrical Code and the envelope to the 2024 International Energy Conservation Code. Water: the well permit comes from that same building official, the well gets tested before anyone signs a certificate of occupancy, and septic approval comes from a state agency standing in front of the town.

The Sun You Actually Get — and Why December Sets the Bill

“Peak sun hours” (PSH) is the number that sizes an array — the equivalent hours per day of full 1,000 W/m² sun once cloud, season and panel angle are baked in. Rhode Island is small enough that geography barely enters into it: Woonsocket and Westerly land within a tenth of a peak sun hour, so the design lever is tilt. At a typical roof pitch an array collects about 4.45 PSH across the year and 2.3 in December. Steepen the racking to a winter angle and December improves to about 2.7 while the annual figure drops to 4.12. Rule of thumb: array kW ≈ daily load (kWh) ÷ (peak sun hours × 0.78) — the 0.78 covers inverter loss, wiring, temperature derate and soiling.

Almost nobody here builds the full December array in one go — a right-sized system pairs a summer-rational array with generator hours or deeper battery reserve through the shortest six weeks. At latitude tilt the array makes 5.47 PSH in July against 2.60 in December, so more than half the summer harvest disappears in midwinter. Steep tilt buys back about 5% of December for roughly 6% of the annual total, which is why a ground mount usually wins here. What's Actually Regulated Here (Which Is Everything)

The permitting question in most states runs jurisdiction by jurisdiction. In Rhode Island it is settled before you start looking:

  • Every parcel is inside a permitting jurisdiction. No county government stands between the state and the town, and there is no unincorporated land. The statewide permit-fee regulation, 510-RICR-00-00-21 § 21.12, sets a project-valuation fee schedule for each of the 39 cities and towns. On a $300,000 build that works out to about $1,320 in Foster and $2,820 in Glocester.
  • One code, four books that matter. A house is built to RISBC-2 (2021 International Residential Code), wired under RISBC-5 (2023 National Electrical Code), plumbed under RISBC-3 (2021 International Plumbing Code) and insulated to RISBC-8, the 2024 International Energy Conservation Code, all effective December 1, 2025.
  • Nothing in the code requires a utility connection. Off-grid is legal here. The code cares about the building — structure, wiring, plumbing, insulation — whether power arrives on a pole or off a roof. The energy code is the one people forget: it regulates the house and ignores the power source.
  • Water is a local permit with a state paper trail. A “water-well permit” here means written approval from your local building official, issued before the building permit for new construction (216-RICR-50-05-2 § 2.2(45)). The finished well is recorded with the Department of Environmental Management under R.I. Gen. Laws Chapter 46-13.2, and the water has to be tested against the Table 1 panel before a certificate of occupancy (§ 2.12.1). Rainwater counts as plumbing: Chapters 13 and 14 of the 2021 International Plumbing Code came in unchanged, so a cistern is a permitted nonpotable system alongside the tested well.
  • The coast has its own arithmetic. In the Salt Pond and Narrow River Critical Resource Area, septic components sit 200 feet back from coastal shoreline features instead of the 50 feet applying elsewhere, and shoreline setbacks run off the Coastal Resources Management Council's shoreline-change rates rather than a fixed line. On a small coastal lot that geometry decides whether the build fits.

Rhode Island DEM Rule 250-RICR-150-10-6 § 6.15

The rule that gates an off-grid build here is the state's onsite wastewater rule, and it stands in front of the building permit rather than beside it. Section 6.15(A) of 250-RICR-150-10-6 requires that “any dwelling or other building having plumbing fixtures from which wastewater is produced, in a location where no public wastewater system is available or accessible, shall be provided with an OWTS of type and design approved by the Director.” Section 6.15(D) closes the door from the other side: “A municipality shall not issue a building permit pursuant to R.I. Gen. Laws Chapter 23-27.3, unless all written approvals by the Director required by these Rules have been presented to the municipality and said approvals are valid at the time of the issuance of the building permit.” That obligation runs to the town, which is why no building official here can help you around it.

On the ground it means a licensed chain. A licensed soil evaluator logs test holes inside the footprint of the proposed leachfield under § 6.16, a licensed designer prepares the application under § 6.9(A), and a licensed installer builds it under § 6.9(B), with a narrow exception letting an owner install a system serving a building they occupy. Holding tanks are off the table for new construction under § 6.9(O). The setback table in § 6.23(E) quietly sets your minimum parcel: at a design flow under 1,000 gallons a day, the leachfield sits 100 feet from a private drinking water well, the tanks 75 feet and the building sewer 50 feet, reducible to 80, 60 and 40 feet on lots of 10,000 square feet or larger. Add § 6.23(B) — 10 feet to a property line, 50 feet to a watercourse — and a lot that looked buildable in a listing photograph can have one legal place for the leachfield.

The consequence people get wrong: assuming a cabin without conventional plumbing, or a composting toilet, moves the build outside the rule. The trigger in § 6.15(A) is plumbing fixtures producing wastewater, which a kitchen sink and a shower satisfy alone. Compost toilets are defined inside these rules, and alternative technologies are handled in § 6.41 as approved system types certified by the Director — options within the approval rather than a way around it. The order is fixed: soil evaluation, DEM approval, building permit, well test, certificate of occupancy. Buying land before the soil evaluation is the most expensive mistake available here.

What an Off-Grid Build Costs in Rhode Island in 2026

Hardware is priced nationally — panels and batteries cost the same in Hopkinton as in Sacramento — so Rhode Island's installed pricing sits inside the national band below. What moves the number here is the December sun and the paperwork. A 2.6-peak-sun-hour December means the array and the battery both run larger for the same daily load, or the design leans on a generator through midwinter. Snow and coastal wind loads add racking engineering, and soft costs bite where every project pulls a permit, a licensed designer draws the septic and a lab tests the well. Same national hardware and labor blend as our full cost report; expect a Rhode Island build to land in the upper half of every one of these bands. The Real Rhode Island Angle: Price First, Storms Second

Rhode Island's grid is not fragile the way a sparse western co-op's is. Seven utilities serve a state ranked 49th for retail sales, on short lines through dense towns. Two things still push people toward stand-alone power. The first is price: at 24.15 cents a kilowatt-hour across all sectors in 2024, Rhode Island had the fourth-highest average retail electricity price in the country. A load costing $2,400 a year on the meter is a different investment case from the same load in a 12-cent state.

The second is the storm track. When Tropical Storm Irene came ashore on August 28, 2011, the National Weather Service's record of the event notes that sustained winds over a six to twelve hour stretch “resulted in power outages to roughly half a million customers throughout the state,” with some households still dark the Friday after — five days later. The nor'easter of October 26 and 27, 2021 knocked out 96,800 Rhode Island customers as gusts hit 50 to 55 mph across northwest Providence County. Superstorm Sandy on October 29, 2012 brought 60 mph gusts inland and 86 mph at Westerly. Hence the interest in battery-backed independence in Washington and Newport counties, where the wind arrives first and the crews last.

Do I need a building permit for an off-grid home in Rhode Island?

Yes, everywhere. There is no unincorporated land here and no municipality without a permit process — the state's fee regulation, 510-RICR-00-00-21 § 21.12, publishes a fee schedule for each of the 39 cities and towns. Your house is built to RISBC-2 (2021 International Residential Code), wired to RISBC-5 (2023 National Electrical Code) and insulated to RISBC-8. Off-grid is legal; it is never unpermitted.

What has to be approved before my town will issue the permit?

The septic system. Under 250-RICR-150-10-6 § 6.15(D), a municipality cannot issue a building permit until the Department of Environmental Management's written approvals have been presented and are still valid. That approval rests on a soil evaluation and a design from licensed professionals, so the order is soil evaluation, then DEM, then the town. It applies to any building with plumbing fixtures producing wastewater.

Is there enough sun in Rhode Island for off-grid solar?

Enough for a well-designed system, though December is the constraint rather than the annual average. At latitude tilt an array here collects roughly 4.4 peak sun hours a day across the year and about 2.6 in December, against 5.5 in July. A steep winter tilt on a ground mount lifts December to around 2.7 and gives up about 6% annually — usually the right trade full-time.

Can I drill a well and collect rainwater on my own land?

Yes, with paperwork on both. A private well needs a water-well permit from your local building official before the building permit issues, the finished well is recorded with DEM under R.I. Gen. Laws Chapter 46-13.2, and the water must be tested against the Table 1 panel before a certificate of occupancy. Rainwater is treated as plumbing: Chapters 13 and 14 of the 2021 International Plumbing Code came in without changes, so a cistern is a permitted nonpotable system supplementing the well. Keep the leachfield 100 feet clear of it.

None of this changes whether off-grid makes sense on your parcel — it changes the order you do things in. Get a soil evaluation before you buy, because the septic approval decides the build and the setbacks decide the lot.
