New Mexico's annual average sits in a fairly tight statewide band, roughly 5.3–5.8 PSH — but that similarity hides a real regional split once you get to December. - Zoning is a separate question from the building code. County zoning — lot size, setbacks, what you can build and where — is adopted and enforced independently of CID's code, and how much of it a given county has on the books varies. Check your specific county's zoning map; don't assume the building code is the only rule in play.
- A domestic well needs a permit, but it's the easy kind. The Office of the State Engineer issues a domestic well permit covering household use and up to one acre of non-commercial landscaping, capped at three acre-feet a year (roughly 977,000 gallons) — an administrative approval, not the contested public-notice process a commercial or irrigation water right can trigger. Drilling itself has to be done by an OSE-licensed well driller. Rooftop rainwater harvesting needs no permit at all, and the state engineer's office actively encourages it for on-site irrigation and domestic use.
- Septic runs through the state, sometimes via the county. The New Mexico Environment Department's Onsite Wastewater (liquid waste) program permits septic systems statewide, either directly or through a delegated county environmental health office depending where you are — plan on a site evaluation and a permit either way, installed by an NMED-licensed contractor.
- Floodplain rules stack on top of everything else. Counties participating in the National Flood Insurance Program regulate construction in mapped floodplains — a real check along the Rio Grande and Pecos valleys specifically, on top of whatever the building code and zoning already require.

New Mexico Statutes § 60-13-44
Section 60-13-44 of the Construction Industries Licensing Act is the sentence that actually decides whether a rural New Mexico build needs a permit at all. The section is titled "Trade bureaus; standards; conflicts," and most of it sets out how CID's electrical, mechanical and general construction bureaus recommend codes to the Construction Industries Commission — but Subsection E is the operative line: "All political subdivisions of the state are subject to the provisions of codes adopted and approved under the Construction Industries Licensing Act. Such codes constitute a minimum requirement for the codes of political subdivisions." Every county and municipality in New Mexico is bound by whatever the commission adopts as the statewide floor, whether or not that county has ever passed a building ordinance of its own.
For someone building off-grid on rural land, this is the piece that trips people up moving in from a state with a genuine rural carve-out: distance from town, unincorporated status and low population don't get a New Mexico parcel out of the code. Who you apply to depends on whether your county maintains its own certified building official. Where it does, the permit runs through that county building department. Where it doesn't — and many rural counties don't — a companion section of the same Act, NMSA 1978 § 60-13-41(E), puts the state itself in that seat: it directs the state to conduct all inspections in a county, municipality or other political subdivision that has no certified building official of its own, which is why CID's own field staff, not a county desk, ends up issuing the permit and doing the inspection on a lot of remote New Mexico land. What the Act allows going the other direction is stricter local amendments on top of the state floor — not softer ones, and not a waiver for acreage that's simply far from anything.
The practical consequence people get wrong: there's no acreage threshold, no distance-from-town line and no owner-builder exemption anywhere in § 60-13-44 that removes the permit requirement for a rural dwelling. The only thing that changes with remoteness is which office issues the permit — county or state field office — never whether one is required.
