What's Actually Regulated in New Hampshire

  • The code exists everywhere on paper; enforcement doesn't.   • Electrical is the real statewide exception.   • Septic runs through the state, not the town. Every new system needs an NHDES Approval for Construction and a separate Approval for Operation, designed by an NHDES-permitted septic designer — the same process in Manchester or an unincorporated grant. A lot under 5 acres carved from a larger parcel adds a state subdivision review on top.

New Hampshire RSA 485-A:32

RSA 485-A:32 is the sentence that actually stops construction on paper: no building with a sewage discharge or disposal system may be built anywhere in New Hampshire until the Department of Environmental Services has approved the plans and specifications first — a state approval, not a town one, running in parallel to whatever a municipality does or doesn’t do about a building permit. The same section calls its own requirements a floor rather than a ceiling: it explicitly leaves local authority intact and treats the chapter’s standards as “minimum,” so a town can layer stricter rules on top but can’t opt out from under it.

In practice, an off-grid builder applies to NHDES, not the town, and the trigger is broad: new construction of any structure that will have a sewage disposal system, expanding an existing structure, increasing the load on one, or converting a camp from seasonal to full-time occupancy all require approval under this chapter (RSA 485-A:38 covers the last three). The real exemptions are narrow — tying into an existing public sewer system, correcting a boundary line between abutters, a bona fide gift of a lot with no construction planned, and in-kind repair or replacement of a failed system under a permit-by-rule. None of them cover building a new off-grid home on raw land.

The mistake people make is assuming that once a town has no building department — true for plenty of small New Hampshire towns under RSA 155-A — nothing stands between them and moving in. Septic approval isn’t that kind of permit; it runs through the state the same way in an unincorporated Coos County grant as it does in Manchester, and it comes in two separate steps, not one: an Approval for Construction lets you install the system, but a second Approval for Operation, issued only after a state field inspector examines it on site, is still required before the system — and the house it serves — can legally be put into use.
