Missouri Revised Statutes § 701.031

Missouri's default rule, set out in RSMo 701.031, is that every property owner disposes of sewage either through a regulated sewer system or through an on-site system installed by someone registered with the Department of Health and Senior Services. But the same section carries the exemption that actually governs most rural off-grid builds here: a single-family residence lot of three acres or more, not adjacent to a lake operated by the Corps of Engineers or by a public utility, is excluded outright from the entire on-site sewage disposal scheme in RSMo 701.025 to 701.059 — no county-administered septic permit, design review or registered-installer requirement applies to that system at all.

That's the part people miss: it isn't your county health department deciding case by case whether you need a permit — it's the acreage and the lake-adjacency test written into the statute itself. Build on a rural parcel of three-plus acres away from one of those lakes and the septic step that would otherwise mean a county-reviewed design and a construction permit simply doesn't apply. Under three acres, or on a lot adjacent to a Corps or public-utility lake, and the full process — administered locally by your county health department under state rules — kicks in.

The exemption isn't a blank check, and that's the one people get wrong. The statute only excludes a qualifying system from the permitting scheme when its components stay "in excess of ten feet from any adjoining property line" and no effluent crosses onto a neighbor's land, reaches surface or groundwater, or "creates a nuisance." Skip the permit because you're on three-plus acres, then run a line too close to the boundary or let a system leach toward a neighbor's well, and you've lost the protection the exemption gave you — the contamination or nuisance itself is still actionable, only now without a county inspector having checked the design first.
