Sun: the state's highest point is about 448 feet, the second-lowest state high point in the country, so there's essentially no elevation effect on solar resource — wherever you land, the sun you get is close to the sun everyone else in Delaware gets. What none of that buys you is inexpensive dirt: Delaware farm real estate averaged $9,550 an acre in 2025, eighth-highest of any state, with pastureland at $7,650, seventh-highest.

The Sun You Actually Get — and Why It Barely Moves Across the State
"Peak sun hours" (PSH) is the number that sizes an array — the equivalent hours per day of full 1,000 W/m² sun once cloud and season are baked in. Delaware's annual average runs roughly 4.1–4.5 depending on where you stand, and because this is a small, flat state, that range barely shifts from the Pennsylvania line to the Sussex County beaches. December is still the month to size for: it runs at roughly 70% of the annual figure, a far gentler winter drop than a northern-tier state sees, but still the month a stand-alone system has to survive without help. Rule of thumb: array kW ≈ daily load (kWh) ÷ (peak sun hours × 0.78) — the 0.78 covers inverter loss, wiring, temperature derate and soiling.

What's Actually Regulated Here (There's No Unzoned Corner)
The permitting question in Delaware isn't jurisdiction-by-jurisdiction the way it is in a big Western state — it's county-by-county among exactly three, and the pattern is consistent:
- Every acre needs a building permit — there's no unincorporated exemption. All three counties require a permit for construction in unincorporated territory as well as their towns; Sussex says so outright, for any construction, anywhere in the county. There is no rural pocket of Delaware where the building department has simply never shown up.
- Which code applies depends on which of the three counties you're in. New Castle enforces the 2021 IBC/IRC (effective January 1, 2024); Sussex enforces the 2021 IBC/IRC (effective January 1, 2023); Kent enforces the 2018 IBC/IRC with its own amendments and names solar panel installations specifically among the projects that need a permit. The 2018 IECC energy code is the one constant — unmodified, statewide, in all three.
- Electrical is the true statewide layer. Delaware adopted the 2020 National Electrical Code statewide in 2021 through the Delaware Fire Commission and Board of Electrical Examiners; a state-licensed inspection agency has to be called within five working days of starting wiring work, whichever county you're in.
- Water and septic both run through the state, not the county. DNREC's Well Permits Program covers every well up to 50,000 gallons a day — effectively all of them — but unlike some states there's no homeowner exemption: every well has to be built by a DNREC-licensed water well contractor. Septic runs through DNREC's Division of Water statewide (7 DE Admin. Code 7101), starting with a licensed soil scientist's site evaluation before a permit even issues.
- Floodplain rules bite harder here than zoning does. Kent and Sussex counties both restrict development within FEMA's mapped 100-year floodplain, and the low ground along Delaware Bay south of the C&D Canal is where that actually matters — a real constraint on a low-lying state, independent of whatever the building code otherwise allows.

7 DE Admin. Code 7301 §3.3
Section 3.0 of Delaware's well regulations, 7 DE Admin. Code 7301, is the actual mechanism behind the no-homeowner-exemption point made above. Section 3.1 requires a well permit and call-in authorization number before any well is constructed. Section 3.3, the license rule, puts the construction, repair, modification or sealing of a well in the hands of a Delaware-licensed well driller or well driver working on-site, and Section 3.4 extends that to the paperwork — the permit application itself has to be prepared and submitted by that same licensed driller or driver, not the landowner.
For someone buying rural land in New Castle, Kent or Sussex County to build off-grid, that means the well is never a do-it-yourself step, however remote the parcel. The property owner, or an authorized agent, signs the application, but a licensed well driller or well driver prepares it, submits it, and does the physical work, from the first excavation through disinfection and any later modification or sealing. Two narrow carve-outs exist: hand-augured soil borings that don't reach the water table need no permit at all, and a straight repair or rehab that doesn't change the well's physical dimensions doesn't need a new one either. A new domestic well qualifies for neither.
The part people building off-grid get wrong isn't the licensing rule; it's the order of operations. The same section says DNREC "will not consider the issuance of a permit for a potable water supply well on an undeveloped parcel until the on-site wastewater treatment and disposal system permit for the parcel has been issued," unless central sewer is already available to it. Off-grid buyers tend to chase the well first, since water feels like the more urgent piece — but on raw land, the septic permit needs to be issued, or already in hand, before DNREC will even take up the well application.

What an Off-Grid Build Costs in Delaware in 2026
