The Sun You Actually Get — Sized for December, Not June
“Peak sun hours” (PSH) is the number that sizes an array — the equivalent hours per day of full 1,000 W/m² sun once cloud and season are baked in. Some cities and larger towns (Burlington among them) have adopted their own local building bylaws that do apply inside town limits, so check with the town clerk before assuming nothing applies.
- Water and wastewater are the real gate. Unlike the building code, Vermont’s Wastewater System and Potable Water Supply Permit is administered statewide by the Department of Environmental Conservation, no county opt-out, and covers essentially any new building that needs a well or a septic system — cabins included. The one carve-out: a “primitive camp” occupied no more than 60 days a year (three consecutive weeks max), with no flush toilet and a composting or incinerating unit instead, doesn’t need the permit.
- Wells and rainwater are lightly touched. Domestic use is exempt from the state groundwater-withdrawal permit entirely — only commercial or industrial draws over 57,600 gallons a day need one — but the well itself has to be drilled by a state-licensed well driller, who must file a completion report within 90 days. Rainwater harvesting for outdoor or non-potable use needs no permit at all; indoor/potable use has to meet International Plumbing Code cross-connection labeling rules.
- Electrical is licensed but owner-friendly. You can wire your own owner-occupied home under the Vermont Electrical Safety Rules without a license, but you can’t touch the service entrance yourself — that’s a licensed electrician’s job, inspected either way. A system that’s never connected to a utility falls outside the Public Utility Commission’s Certificate of Public Good process entirely; that paperwork exists to govern grid interconnection, not a standalone array.
- Act 250 mostly isn’t about your one house. Vermont’s 1970 land-use law is famous, but building a single home on a lot you already own rarely triggers it — its jurisdiction is aimed at subdivision and commercial development. It kicks in on projects over 10 acres, or subdividing 10-plus lots in five years, in towns that have adopted zoning and subdivision bylaws — and at just over one acre in the roughly 45% of Vermont towns that haven’t. Vermont 10 V.S.A. §1973
The statute that actually gates an off-grid build in Vermont isn’t a building code — it’s this one. 10 V.S.A. §1973 requires a permit from the Secretary of Natural Resources, administered through the Department of Environmental Conservation, before any of eight listed actions — and three of them cover almost every off-grid project: constructing, replacing or modifying a potable water supply or wastewater system; constructing a new building or structure; and subdividing land. It’s one statewide process that applies the same way whether or not the town has adopted its own zoning and subdivision bylaws.
The chapter’s definitions section narrows who the “new building or structure” trigger actually catches: under 10 V.S.A. §1972, that phrase only covers a building “whose use or useful occupancy requires the construction or modification of a potable water supply or wastewater system.” In practice that means almost any year-round off-grid home — anything with a kitchen sink, a bathroom, or a well — falls inside the permit requirement, while a genuinely unplumbed structure sits outside it. There’s no separate water permit and septic permit to juggle; it’s one application and one permit covering both systems together, and the chapter carries its own exemptions — the primitive-camp carve-out described above is one of them.
The consequence people get wrong: this isn’t a permit you apply for once the well is drilled or the septic is dug. Constructing the building itself is listed as its own triggering action in subsection (a), separate from installing the water supply or wastewater system, so if the house needs a well or septic at all, the permit has to be issued before construction starts — not before the tap gets turned on. Framing the house first and sorting out water and wastewater afterward isn’t how the statute is sequenced, even though that’s the order most builders expect coming from states with a conventional building-permit process.
