New York breaks the pattern that makes off-grid look easy in the no-code states. There is no county here that quietly enforces nothing, because state law never left that door open — a town can vote itself out of code enforcement and the job lands on the county; if the county votes itself out too, the Secretary of State takes over. What the state hands back is land. Farm real estate here averaged $4,300 an acre in 2025 against a Northeast average of $7,300, and pasture came in at $1,950, the cheapest in the region. The other half of the trade is the sun: December is thin statewide, and behind Lake Erie and Lake Ontario it is thin enough to redesign the whole system around.

Why New York Is Cheap Land Under a Code That Never Switches Off
Three things stack here, and the balance between them is unusual. Land: USDA's National Agricultural Statistics Service put New York farm real estate at $4,300 an acre in 2025, up 3.6% on the year, with cropland at $4,010 and pasture at $1,950 — the lowest pasture value of any Northeast state in the survey, well under the $7,300 regional average that Connecticut, New Jersey and Massachusetts drag upward. Law: the Uniform Fire Prevention and Building Code applies in every jurisdiction outside New York City, and Executive Law § 381(2) keeps enforcement mandatory somewhere in the chain even when a town declines the work. Water: no state permit for a household well, though a registered contractor has to do the drilling, and the state's withdrawal permit program does not start until 100,000 gallons a day. The Sun You Actually Get — and Why December Runs the Design
“Peak sun hours” (PSH) is the number that sizes an array — the equivalent hours per day of full 1,000 W/m² sun once cloud, season and angle are baked in. New York's annual figure on a south-facing array is respectable, roughly 3.8 to 4.4. December is a different state. At Albany a steeply tilted array averages about 2.3 peak sun hours a day in December against 5.8 in June; at Buffalo December drops to about 1.7, under a third of midsummer output. That gap is the entire New York design problem. Rule of thumb: array kW ≈ daily load (kWh) ÷ (peak sun hours × 0.78) — the 0.78 covers inverter loss, wiring, temperature derate and soiling.

*Sized on the December row with steep winter-tilt racking; almost nobody in New York builds the full winter array, because the arithmetic gets absurd — a right-sized system pairs a summer-rational array with generator hours or a deeper battery through the shortest weeks. What's Actually Regulated Here (Everywhere, Which Is the Point)
The permitting question in New York is who administers the code rather than whether one applies, and the pattern holds statewide:
- Every jurisdiction, with no genuine exception. The Uniform Fire Prevention and Building Code is administered by the town, village or city; a local government that declines the work by local law hands it to the county, and a county that also declines hands it to the Secretary of State (Executive Law § 381(2)).
- A town can be stricter than the state. Executive Law § 379 lets a local legislative body adopt “higher or more restrictive standards,” subject to a petition to the State Fire Prevention and Building Code Council, which has to find them “reasonably necessary because of special conditions prevailing within the local government.” The state code is a floor rather than a ceiling.
- Inside the Adirondack Park, a second review. Under Executive Law § 810 a single family dwelling in a resource management area is a Class B regional project, reviewed by the Adirondack Park Agency unless the town runs an Agency-approved land use program. Section 805 sets the density behind it: about 15 principal buildings per square mile in resource management, roughly 43 acres each, and about 75 in rural use areas.
- Water and septic. No state permit to drill a household well, but Environmental Conservation Law § 15-1525 requires the driller to hold a DEC certificate of registration, file a notice before drilling and file a completion report with the log, depth and pump capacity afterward. Septic goes through the county health department where one runs a full environmental health program, and through a state Health Department district office where the county is partial-service — Jefferson County refers residents to the Watertown office.
- Fossil-fuel equipment in new buildings. Energy Law § 11-104(6)(b) directs the code to prohibit installing fossil-fuel equipment and building systems in new buildings up to seven stories on or after December 31, 2025. A propane furnace or a gas range in a new off-grid house sits inside that prohibition.

New York Executive Law § 381(2)
This is the real off-grid gate in New York, and it is why the search that works in Alabama or Colorado — find the county that enforces nothing — comes up empty here. Section 381(2) provides that “every local government shall administer and enforce the uniform fire prevention and building code,” with the qualifier that a local government “may enact a local law … providing that it will not enforce such codes.” The opt-out is genuine, and a dead end for anyone hoping to build unwatched: where a town takes it, “the county in which said local government is situated shall administer and enforce such codes,” and where the county has declined too, “the secretary in the place and stead of the local government shall, directly or by contract, administer and enforce the uniform code.”
What moves is the desk the paperwork sits on. The permit, the inspections and the certificate of occupancy travel with the code rather than with the town, and they reach a parcel on the Tug Hill or in the western Catskills the same way they reach a village lot. Two neighboring sections close the gaps. Section 383 makes the uniform code supersede inconsistent local law, carving out only cities of over a million people that keep an equally stringent code of their own. Section 382 backs the structure with fines, imprisonment for continued violations, and a court's power to order an offending building removed.
The consequence people get wrong: treating a rural New York town with a part-time code enforcement officer as functionally code-free. The officer's schedule is a staffing fact, and the obligation to permit and inspect the build does not move with it. Off-grid status changes nothing either — no threshold of remoteness, acreage or utility disconnection takes a dwelling outside the uniform code. Find out early which body administers the code on the parcel, because a county or state program carries different queues, fees and inspection travel than a village office.

What an Off-Grid Build Costs in New York in 2026
Hardware is priced nationally — panels and batteries cost the same delivered to Malone as to Sacramento — so New York's installed pricing sits inside the national band below. What moves here is everything else. A December running between 1.6 and 2.5 peak sun hours means a bigger array, more battery, or both; lake-effect cloud means autonomy measured in days; snow country means steep tilt, heavier racking and a mounting height that lets the array shed; and cold means the battery bank lives in a conditioned space. Same national hardware and labor blend as our full cost report; expect a New York build to sit in the upper half of every band, and at the top of it behind Lake Erie or Lake Ontario. Three things push it there: winter sizing that adds array and battery a southern build never needs, snow-load and steep-tilt racking, and a code that is permitted and inspected everywhere, so design and inspection costs are in from day one. The Real New York Angle: Wet Snow, Long Restorations and Carbon Monoxide
New York's grid is not fragile in the abstract, and the state's utilities restore ordinary storms quickly. The events worth planning around are the ones that put trees through the distribution network at scale. On October 12 and 13, 2006, an early lake-effect storm dropped 22.6 inches of wet snow on a still fully leafed Buffalo; more than 400,000 National Grid and NYSEG customers lost power, most regions went about five days without it, and full restoration took 13 days. Superstorm Sandy came ashore on October 29, 2012, and Department of Energy situation reports recorded a peak of 2,097,933 New York customers cut off. Tropical Storm Isaias followed on August 4, 2020, cutting service to roughly 800,000 in southeastern New York — the largest tropical-cyclone outage there since Sandy, per the National Hurricane Center.
The 2006 storm also carries the detail that should shape a New York backup plan. Fourteen deaths were indirectly attributed to it, four of them from carbon monoxide poisoning caused by improperly used generators and kerosene heaters, and more than two hundred people were treated for exposure. A five-day outage in the cold is exactly the scenario in which a household drags a generator indoors, and a properly sized battery bank with a vented, correctly sited generator behind it answers the same problem without that failure mode. The regulatory clock runs alongside: Energy Law § 11-104 now pushes new construction off fossil fuels, and its only utility-side exemption covers a project applying for new or expanded electric service “when electric service cannot be reasonably provided by the grid,” with the Public Service Commission deciding what is reasonable. A house that never asks the utility for service never triggers that determination, so get the code answer on propane heat in writing early.
Is there a county in New York with no building code?
No. Executive Law § 381(2) requires every local government to administer and enforce the state Uniform Code. A town may decline the work by local law, but then the county takes it, and if the county declines too the Secretary of State enforces the code directly or by contract. Permits, inspections and a certificate of occupancy apply to an off-grid house like any other, with no exemption for remoteness or acreage.
Is there enough sun in New York for off-grid solar?
Yes, though December is what you design for. A south-facing array at steep winter tilt averages roughly 2.5 peak sun hours a day in December on eastern Long Island and about 2.3 at Albany, dropping to about 1.7 behind Lake Erie and Lake Ontario — under a third of the same array's June output. Sized purely on that December figure, a 30 kWh-a-day home needs 15 to 24 kW, which is why most New York systems pair a summer-rational array with a deeper battery or generator hours through the shortest weeks.
Can I drill a well or run a septic system on my own land in New York?
A household well needs no state permit from the owner, but the drilling must be done by a contractor registered with the Department of Environmental Conservation under ECL § 15-1525, who files a notice before drilling and a completion report afterward. The state's water withdrawal permit program does not start until 100,000 gallons a day, so a home never reaches it. Septic is reviewed by the county health department, or by a state Health Department district office in partial-service counties. Testing the well is the owner's job.
What does the Adirondack Park add to an off-grid build?
A second layer of review on private land inside the Park. Under Executive Law § 810 a single family dwelling in a resource management area is a Class B regional project, which the Adirondack Park Agency reviews unless the town operates an Agency-approved land use program. Section 805 puts the density behind that classification at roughly 15 principal buildings per square mile, about 43 acres each. None of it replaces the building permit.
None of this changes whether off-grid makes sense on your parcel — it changes what to check before you sign anything.
