Nebraska's statewide annual average sits close to the national figure, roughly 4.6–5.4 depending on where you stand, and it climbs a little as you move west into the drier, higher-elevation Panhandle. What's Actually Regulated Here (Shorter List Than You'd Think)

The permitting question in Nebraska is county-by-county, but the pattern is consistent:

  • Inside a city, village, or a county that's adopted a code? Then Nebraska's State Building Code, or the local government's own equivalent, applies and you pull permits like anywhere else.
  • Rural county that's never adopted zoning or a building code? Genuinely common on open Sandhills and Panhandle land — county zoning power here is enabling, not mandatory, and a real share of thinly populated counties have adopted little or none. Since 2019, Nebraska's LB96 makes the state building code the default backstop where a local government hasn't adopted its own within two years of a code update — but it explicitly exempts any building on a farm or used for farm purposes, and a separate statute (§ 23-114.03) frees a genuine farm building on 20+ acres generating at least $1,000 a year in farm sales from county permits outright. Whether your actual house counts as "farm purposes" is a county-by-county judgment call — ask before you build, not after.
  • Electrical is licensed and inspected statewide. Wiring work runs through the State Electrical Division regardless of what the county requires for the structure itself — budget for that inspection even on unzoned land.
  • Water and septic. A domestic or livestock well is exempt from Natural Resources District permitting even inside a designated groundwater management area, but it still has to be drilled by a state-licensed water well contractor and registered with the state if completed after July 1, 2001. Septic runs through the state's Title 124 onsite-wastewater standards, with the permit itself issued locally by the county.
  • Floodplain. Counties in the National Flood Insurance Program regulate structures in mapped floodplains — worth checking specifically along the Platte and Missouri valleys.

Nebraska Revised Statutes § 46-735

This is the section that actually decides whether you need a permit to drill your own well. It requires anyone constructing a new water well inside one of Nebraska's designated ground water management areas to apply to the district first — except that § 46-735 exempts "a single water well designed and constructed to pump fifty gallons per minute or less," which covers the pumping capacity of an ordinary household connection or a stock tank several times over. Outside a designated management area, this permit requirement doesn't apply to any well at all.

For someone building off-grid on rural Nebraska land, the practical effect is that the well most builds actually need — a single line to the house, maybe a stock tank — almost never triggers an NRD permit, whether or not the land sits inside a management area. Districts do get a narrower hold in areas where ground water levels are declining and the district has adopted rules to control it: there, the exemption shrinks to wells serving ordinary household needs, fire protection, sanitation, or range livestock, so a small well drilled mainly to irrigate a garden or orchard in one of those regulated districts can lose the automatic pass that a house-and-stock well keeps.

The consequence people get wrong: the 50-gpm exemption is measured per well, and the statute lets a district count two or more wells that are physically combined, clustered, or joined together as a single system against that limit. Drill the house well exempt, then add a second small well for a shop or an orchard later without checking whether the district treats them as connected, and a setup that would have qualified as exempt if permitted together from the start can end up needing a permit it never planned for.

The Public-Power Angle: A Distance Decision, Not a Grid-Distrust One

Nebraska is the only state in the country where 100% of electric customers buy from a publicly owned utility — a municipal system, a rural cooperative, or one of the public power districts that bought out the last investor-owned utility operating here in December 1949. Do I need a building permit for an off-grid home in Nebraska?
