Off-Grid in Florida: Land, Permits, Solar & Cost

Florida breaks the pattern this series has followed state by state. Almost everywhere else the first question is which counties enforce a building code and which ones quietly don't. Florida has no such county. One code covers all 67 by statute, it takes effect the moment the state Building Commission adopts it, and every city and county has to enforce it. The upside sits in the other two columns. December here still delivers roughly 3.8 to 4.6 peak sun hours on a south-facing array at latitude tilt, close enough to the annual average that the winter design barely fights the summer one. And the storm record — Irma, Michael, Ian, Milton, all inside eight years — is the plainest argument for owning your own power any state in this series offers.

Why Florida Costs More on Land and Law Than It Does on Sun

Three things stack here, and the first two run against you. Land: USDA NASS's 2025 survey put Florida cropland at $10,550 an acre, fifth-highest in the country against a national average of $5,830, with pasture at $7,400 against a national $1,920 — nearly four times the national pasture price. The realistic homestead number sits elsewhere: North Florida timberland transacted above $3,900 an acre on average in the second quarter of 2025, and that is where affordable acreage here lives. Law: the Florida Building Code is adopted for statewide use without any action by local government (Florida Statutes § 553.73(6)), every local government has to enforce it (§ 553.80(1)), and building without a permit is unlawful anywhere in the state (§ 553.79(1)(a)). Water: a well needs a construction permit from your water management district and a licensed contractor to drill it, and septic runs through the county health department. Nothing here is hostile. It is simply all on the record.

The Sun You Actually Get — a Winter That Hardly Argues

“Peak sun hours” (PSH) is the number that sizes an array — the equivalent hours per day of full 1,000 W/m² sun once cloud, season and tilt are baked in. Florida's annual figure on a south-facing surface at latitude tilt runs roughly 5.0 to 5.4 statewide, and December holds between about 75% and 88% of that depending on how far south you stand. That is the whole Florida sun story: the December array and the June array sit close enough together that most builds get sized straight to the winter number, with no generator carrying the shortfall. Rule of thumb: array kW ≈ daily load (kWh) ÷ (peak sun hours × 0.78) — the 0.78 covers inverter loss, wiring, temperature derate and soiling.

Tilt matters more here than the brochure suggests — flat on the horizontal plane, Orlando's December drops to about 3.1 and Tallahassee's to about 2.8, so a low-slope roof mount and a tilted ground array are different systems in winter. And Florida's weakest month for a tilted array isn't December: Orlando bottoms out near 5.0 in June and July, when afternoon cloud and panel heat both eat production.

What's Actually Regulated Here (Longer List Than Most States in This Series)

Florida's permitting picture doesn't change at the county line the way Alabama's or Colorado's does. The pattern:

  • A permit, everywhere. Florida Statutes § 553.79(1)(a) makes it “unlawful … to construct, erect, alter, modify, repair, or demolish any building within this state without first obtaining a permit,” and § 553.80(1) puts enforcement on every local government. There is no rural exemption and no unincorporated gap to build into.
  • Local governments may go stricter, never looser. Under § 553.73(4)(b) a local government can adopt technical amendments more stringent than the state minimum, no more than once every six months, after a hearing showing a local need — and those expire at the next triennial update unless the Commission carries them forward. Coastal counties use it. Nobody uses it to opt out.
  • Building it yourself. Florida Statutes § 489.103(7) lets a property owner act as their own contractor on a one- or two-family residence or a farm outbuilding for their own occupancy, so long as it isn't offered for sale or lease. It waives the contractor license, never the permit.
  • Water and septic. A well needs a construction permit before drilling (Florida Administrative Code Rule 62-532.400) and a Florida-licensed contractor to drill it (Rule 62-531). Septic is permitted through your county health department under § 381.0065, with rule authority moved to the Department of Environmental Protection on July 1, 2021. Roughly 2.6 million systems statewide serve about 30% of Floridians.
  • Nobody can zone out your array. Florida Statutes § 163.04 prohibits any local ordinance that bans solar collectors or other renewable energy devices, and voids deed restrictions that try the same thing. An approving body can specify where on a south-facing roof plane the panels go, and no further.

Florida Statutes § 553.73(6)

The real off-grid gate in Florida is one sentence long: “The initial adoption of, and any subsequent update or amendment to, the Florida Building Code by the commission is deemed adopted for use statewide without adoptions by local government.” Read alongside § 553.80(1), which obliges every local government to enforce that code on all public and private buildings, and § 553.79(1)(a), which makes building without a permit unlawful anywhere in the state, it closes the door off-grid buyers in most other states go looking for. The move that works in rural Alabama or Saguache County, Colorado — find the county with no building department — has no Florida equivalent, because adoption never depended on the county.

Section 553.73(10) carries the exemptions, and one reads as if written for this audience. A structure under 1,000 square feet built for hunting falls outside the code, but only if it is not rented, leased or used as a principal residence, is not inside FEMA's mapped 100-year floodplain, and — the striking condition — is “not connected to an offsite electric power or water supply.” Florida's code already contains an off-grid carve-out and expressly refuses to let anyone live in it. The rest run the same way: nonresidential farm buildings on farms sit outside the code, and storage sheds under 720 square feet “not designed for human habitation” are relieved of the mandatory wind-borne-debris-impact standards rather than of the code as a whole. Every carve-out is defined by the building not being a home.

The consequence people get wrong runs both ways. Buyers arriving from a no-code state assume the rules thin out far enough down a dirt road in Dixie or Liberty County, and they don't. Buyers already here plan around a “shed” or a hunting cabin and expect to move in, which the statute's own conditions rule out. The practical read: assume a permitted, inspected, wind-rated build wherever you buy, budget the engineering in before plan review, and treat the county as administering a code it did not write and cannot weaken.

What an Off-Grid Build Costs in Florida in 2026

Hardware is priced nationally — panels and batteries cost the same delivered to Ocala as to Sacramento — so Florida's installed pricing sits inside the national band below. What moves here is the structural side: every array is a permitted, engineered attachment, product approvals have to be in the submittal, and coastal counties layer stricter amendments on top under § 553.73(4)(b). Pushing the other way is a mild winter, which cuts battery autonomy days and removes the cold-weather line items other states carry. Where Florida lands inside each band. The seasonal-cabin band sits in its upper half almost everywhere, because the informal small build that pulls this band's floor down in no-code states isn't available under § 553.79(1)(a) — permit, engineering and inspection are fixed costs a 3 kW system can't spread thin. The full-time home band splits: the middle of the band inland in North and Central Florida, where mild winters cut battery days, and the upper half in coastal counties running stricter local amendments. The largest band sits in its upper half statewide, since a 12–15 kW ground array is a big enough wind-load structure that engineering and foundations stop being a rounding error. The Real Florida Angle: A Grid That Works Until the Storm Lands

Florida's grid is not fragile day to day. It is exposed, and the record is specific. Hurricane Irma came ashore on September 10, 2017; outages peaked the following afternoon at 6.7 million customers, 64% of every electricity account in the state, and about 100,000 were still dark on September 19. Hurricane Michael made landfall near Mexico Beach on October 10, 2018, later reanalyzed by the National Hurricane Center as a Category 5 with 160 mph winds, the strongest landfall on record for the Panhandle. Hurricane Ian crossed the peninsula between September 28 and October 1, 2022, cutting power to roughly 3.28 million Florida customers, 2.78 million of them at once at the peak. Hurricane Milton left 3.4 million without power in October 2024. Four events in eight years, each a multi-day to multi-week restoration for households at the wrong end of the line.

That changes the off-grid calculation here. In most states the argument for stand-alone power is distance — the cost of pulling a line to a parcel that has none. In Florida the argument is the restoration window. A parcel five miles outside a small town sits on the feeder that gets rebuilt last, and a household running its own array, batteries and well pump rides that out in a way a grid-tied home with a transfer switch and a fuel run does not. Whatever else Florida regulates tightly, § 163.04 means your right to generate your own power is not up for a vote.

Can I build an off-grid home in Florida without a permit?

No. Florida Statutes § 553.79(1)(a) makes it unlawful to construct any building in the state without first obtaining a permit, § 553.80(1) requires every local government to enforce the code, and § 553.73(6) adopts the Florida Building Code statewide without any local adoption step. There is no no-code county to move to, and the exemptions in § 553.73(10) are all defined around the building not being a dwelling — the hunting-structure carve-out expressly requires that it is not a principal residence.

Is there enough sun in Florida for off-grid solar?

Yes, and December is unusually kind here. On a south-facing array at latitude tilt, annual peak sun hours run roughly 5.0 to 5.4 across the state and December holds around 3.8 in Jacksonville, 4.0 in Tallahassee, 4.4 in Central Florida and 4.6 in Miami — close enough that most Florida systems get sized straight to the December number, with tilt doing the work.

Do I need permits for a well and septic on off-grid land in Florida?

Both, yes. A water well requires a construction permit before drilling under Florida Administrative Code Rule 62-532.400, issued by your water management district or its delegated county agency, and the work has to be done by a Florida-licensed water well contractor under Rule 62-531. Septic is permitted and inspected by your county health department under § 381.0065, administered by the Department of Environmental Protection since July 1, 2021. One thing to watch on land near growth: if a public or investor-owned sewer becomes available, § 381.00655(1)(a) gives you 365 days from written notice to connect.

Can I act as my own contractor on a Florida off-grid build?

On a one- or two-family residence or a farm outbuilding for your own occupancy, yes — Florida Statutes § 489.103(7) exempts an owner-builder from contractor licensing, provided the property isn't offered for sale or lease. The conditions are real: direct on-site supervision by you, no unlicensed person running the job, and selling or leasing within one year of completion creates a legal presumption you built it for sale, which breaks the exemption.

None of this changes whether off-grid makes sense on your specific parcel — it changes what to check before you sign anything. Price the land honestly, since Florida's affordable acreage is North Florida timberland rather than peninsula pasture. Assume a permitted, engineered, wind-rated build wherever you buy, with that engineering in the first quote. Then size on the December row, which here costs very little.
