Off-Grid in Massachusetts: Land, Permits, Solar & Cost

Massachusetts is the state where going off-grid is entirely legal and impossible to do quietly. Every acre of the Commonwealth sits inside one of 351 cities and towns, each required by statute to employ a building inspector, and the state building code applies in all of them. There is no unzoned rural county to disappear into, because there is no unincorporated land. What you get in exchange is a state that treats a stand-alone solar system as an ordinary thing to build: zoning cannot unreasonably regulate a solar installation anywhere here, the rain on your roof is yours, and the inspector who signs off your array works from the same national code everyone else uses. Two numbers decide most projects: land at $14,900 an acre, and December, which hands over barely half the sun the annual average suggests.

Expensive Land Under a Code Nobody Opts Out Of

Three things stack here. Land: USDA NASS put Massachusetts farm real estate at $14,900 an acre in its August 2025 Land Values summary, up 4.2% in a year, against $7,300 for the Northeast and $4,350 nationally; cropland averaged $26,000 and pasture $15,100. That is why a Massachusetts homestead runs five or ten acres rather than forty. Law: the building code is mandatory statewide, and M.G.L. c. 143, § 3 requires every city and town to employ an inspector of buildings or building commissioner to enforce it, so the permit counter always exists. Water: MassDEP does not regulate private wells at all — your board of health does, under its own adopted regulation covering siting, construction, water quality and quantity — while septic runs on a genuinely statewide track through Title 5. Rainwater collection carries no state cap, and the Commonwealth publishes its own homeowner guide to rain barrels.

The Sun You Actually Get — and Why December Sets the Whole Design

“Peak sun hours” (PSH) is the number that sizes an array — the equivalent hours per day of full 1,000 W/m² sun once cloud, season and angle are baked in. Massachusetts runs 4.2 to 4.4 PSH a year at optimal tilt. December is the problem: the same locations drop to between 2.3 and 2.9, so a stand-alone system gets sized on the December row, and the design question becomes how much of the gap a generator covers. Rule of thumb: array kW ≈ daily load (kWh) ÷ (peak sun hours × 0.78) — the 0.78 covers inverter loss, wiring, temperature derate and soiling.

Every figure is at optimal tilt, and in December that optimum runs 60 to 64 degrees across Massachusetts — close to vertical, which is also the angle that sheds snow instead of holding it. Laid flat, a December array in eastern Massachusetts collects about 1.5 PSH against 2.9 at steep tilt, so half the winter harvest rides on racking angle alone. What's Actually Regulated Here (All of It, Everywhere)

In most states the permitting question is which county you land in. Here the answers are the same everywhere, and only the queue length changes:

  • Building permit, in every town. The next section covers it; the exemption list at 780 CMR 105.2 tops out at sheds of 120 square feet.
  • Electrical is its own track. M.G.L. c. 166, § 32 requires every city and town to appoint an inspector of wires who is himself a licensed electrician, and M.G.L. c. 143, § 3L requires notice to him within five days of starting any wiring installed for hire, with approval or disapproval due five days after the completion notice. He inspects against 527 CMR 12.00, used alongside NFPA 70.
  • Water and septic, both through the board of health. Title 5 (310 CMR 15.000) designs a single-family system at 110 gallons per day per bedroom with a 330 gpd floor, and puts the soil absorption system at least 100 feet from a private well, the tank 50 feet. Wells are the genuinely local piece: MassDEP does not regulate them, and the board's own private well regulation governs siting, depth, casing and testing. Statewide, only Massachusetts Registered Well Drillers may install one, under 310 CMR 46.00.
  • Zoning cannot block the array. M.G.L. c. 40A, § 3 says no zoning ordinance or by-law “shall prohibit or unreasonably regulate the installation of solar energy systems or the building of structures that facilitate the collection of solar energy, except where necessary to protect the public health, safety or welfare.”
  • The energy code applies to you too. IECC 2021 with Massachusetts amendments at 780 CMR Chapter 11R, plus two opt-in tiers a town may adopt above it: the Stretch Code at 225 CMR 22 and the Specialized Code at 225 CMR 22 with Appendix RC.

Massachusetts State Building Code 780 CMR 101.2

The real off-grid gate in Massachusetts is the first line of the building code's scope section. 780 CMR 101.2 reads: “780 CMR shall be the building code for all towns, cities, state agencies or authorities in accordance with M.G.L. c. 143, §§ 93 through 100.” No acreage threshold, no rural exemption, no mechanism for a town to decline. Section 105.1 supplies the enforcement: it is unlawful to construct, alter, repair or demolish a building “without first filing an application with the building official and obtaining the required permit.”

The building official on the other side of that counter exists because of the statute behind the code. M.G.L. c. 143, § 3 requires the chief administrative officer of each city or town to employ and designate an inspector of buildings or building commissioner, plus whatever local inspectors are reasonably necessary to enforce the code. Since all Massachusetts land is incorporated, the office is universal; small towns often share one commissioner across a district, which changes only how long you wait. The current text is the Tenth Edition, effective October 11, 2024, and the only edition permits have been issued under since July 1, 2025.

Building it yourself is still allowed. The exception at 780 CMR 110.R5.1.3.1 exempts “any homeowner performing work for which a building permit is required” from construction supervisor licensing, on the condition that a homeowner who engages anyone for hire acts as supervisor of that work. A homeowner, the code says, owns the parcel and resides or intends to reside there in a one- or two-family dwelling — and “a person who constructs more than one home in a two-year period shall not be considered a homeowner.” So an owner-builder needs no license, and still files the application, builds to the code including its energy chapter, and passes inspection.

The consequence people get wrong is arriving from a state where the answer softens with distance. In Alabama or Colorado, picking a county with no adopted code is a real strategy. Here the code reads the same in Mount Washington, population under 200, as in Newton.

Massachusetts builds in the upper half of all three bands, and the December column above is most of the reason. A 30 kWh-a-day house sized honestly on winter light wants 13 to 17 kW of array, which lands it at the top of the middle band or straight into the third, and the battery carries more consecutive dark days than a southern bank does. Add snow-load engineering, a conditioned space for the battery and New England labor rates, and the lower half of each band belongs to a seasonal cabin that shuts down in January.

The Real Massachusetts Angle: Expensive Power and a Grid the Wind Keeps Finding

Start with the number that drives every conversation here. In May 2026 the average Massachusetts residential electricity price was 28.82 cents per kilowatt-hour, against 18.44 nationally, on the EIA's monthly table. That gap is why a long private drive changes the arithmetic so fast: the grid you would connect to is among the most expensive in the country, and the extension gets paid for before the first kilowatt-hour arrives.

Then reliability, which here is a wind and wet-snow story. Tropical Storm Irene, on August 28, 2011, peaked at 567,000 Massachusetts customers without power in Department of Energy situation reports. The blizzard of February 8 and 9, 2013 peaked at 402,814. Hurricane Sandy, on October 29, 2012, peaked at 298,072. The March 2 nor'easter in 2018 put 156,742 customers out inside 24 hours. Four events in seven years, each measured in hundreds of thousands of meters, none a rare weather type for New England.

The last piece is what the state pays for. Massachusetts is generous to grid-tied solar through SMART, under 225 CMR 20.00, where the incentive is a tariff paid by the utility and eligible projects must be interconnected by Eversource, National Grid or Unitil. A system that never touches the distribution network has nothing to enroll in, so off-grid gets priced against a 28-cent grid, the poles to reach you, and the four storms above.

Do I need a building permit for an off-grid home in Massachusetts?

Yes, everywhere. 780 CMR 101.2 makes the state code the building code for all cities and towns, and 105.1 makes building without a permit unlawful; the exemption list stops at sheds of 120 square feet. What you don't need is a licensed contractor: 780 CMR 110.R5.1.3.1 lets a homeowner build their own one- or two-family dwelling without a construction supervisor license, provided they supervise anyone hired and don't build more than one home in two years. Wiring is a separate permit through the inspector of wires.

Can I use a composting toilet instead of a septic system?

You can use one, and it rarely replaces the system. Under Title 5 at 310 CMR 15.289, composting toilets are certified for general use in new residential construction only “where a system in full compliance with 310 CMR 15.000 could otherwise be installed on the site” — the lot still has to pass as if you were building a conventional system. Greywater discharge needs a septic tank and soil absorption system, and 310 CMR 15.262 caps the reduction in absorption area at 50%. A privy is possible with written board of health approval, never within 30 feet of a building used for sleeping or eating.

Is there enough sun in Massachusetts for off-grid solar?

For a full-time house, yes, if you size for December. Annual peak sun hours run 4.2 to 4.4 at optimal tilt, but December drops to 2.9 around Boston and Worcester and 2.3 in the Berkshires, so the winter array for a 30 kWh-a-day home lands between 13 and 17 kW. Tilt does more work here than in any southern state: December's optimum is 60 to 64 degrees, and a flat-laid array collects about 1.5 peak sun hours against 2.9 at that angle, which is also the angle snow slides off.

Do Massachusetts solar incentives apply to an off-grid system?

No. SMART, the state's solar incentive under 225 CMR 20.00, pays a tariff through the distribution utility, and eligible projects must be interconnected by Eversource, National Grid or Unitil. The federal 30% credit under Section 25D also ended for systems completed after December 31, 2025. What remains is the avoided line extension and a grid price of 28.82 cents per kilowatt-hour as of May 2026, against 18.44 nationally.

None of this changes whether off-grid makes sense on your specific parcel — it changes what to check before you sign anything. Get the board of health to confirm the lot can pass Title 5 and support a well before you buy, since that pairing kills more projects here than any building inspector does. Size the array and the racking angle on your region's December number. And price it against a real line-extension quote, because at 28.82 cents a kilowatt-hour the comparison is closer here than almost anywhere else.
