Why Tennessee Costs More Than Its Neighbors and Regulates More Than You'd Guess
Three things stack here, the same three that decide every state in this series. Land: at $6,150 an acre for farm real estate in 2025, Tennessee is the priciest state in USDA's Appalachian region and the fastest-rising, well clear of Kentucky at $5,480 and North Carolina at $5,470; pasture alone averages $5,600 an acre against $1,920 nationally, which tells you how much of the market is set by people buying acreage to live on. The Sun You Actually Get — a Mild December With One Cloudy Pocket
“Peak sun hours” (PSH) is the number that sizes an array — the equivalent hours per day of full 1,000 W/m² sun once cloud, season and tilt are baked in. Tennessee's annual figure on a south-facing array at latitude tilt runs about 4.5 to 4.8, and December holds roughly two-thirds of that — a far softer winter than anywhere north of the Ohio River. The regional spread is small in summer and worth real money in winter: Middle Tennessee and the northeastern mountains lose the most December output to persistent cloud, while the Knoxville valley and West Tennessee hold up best. Rule of thumb: array kW ≈ daily load (kWh) ÷ (peak sun hours × 0.78) — the 0.78 covers inverter loss, wiring, temperature derate and soiling.

The winter dip is mild enough that most Tennessee installers size straight to the December number, so the array in the table is close to a right-sized, year-round system. Steepening the winter tilt buys back a few percent — at Nashville a 58° December tilt lifts 3.0 to about 3.2.
What's Actually Regulated Here (More Than in Most of the South)
The permitting question in Tennessee is jurisdiction-by-jurisdiction, but the default runs the opposite way from Alabama or Mississippi:
- The state code is the starting point. The State Residential Building Code Enforcement Program covers one- and two-family dwellings and townhouses everywhere except jurisdictions that took an exemption from the State Fire Marshal's Office by enforcing local codes themselves, or that “opted out of state residential building codes and enforcement by a 2/3 vote of the city or county's legislative body.” The adopted codes are the 2018 IRC and the 2018 IECC.
- Opt-out counties are real and they are listed. The SFMO publishes a status table marking every jurisdiction exempt, state-program or opted out. Counties showing as opted out on the list dated July 20, 2026 include Fentress, Morgan, Scott, Johnson, Unicoi, Bledsoe, Cocke, Benton and Franklin. A city can carry a different status from the county around it, so read the row that matches your address.
- Building it yourself is written into the law. A property owner may build a single residence once every two years for their own use, without a contractor's license, as long as it isn't for resale, lease or rent (T.C.A. § 62-6-103). The state mirrors that with a homeowner permit, issued where the owner hasn't had one in the prior 24 months. Any contractor you hire whose portion runs $25,000 or more has to be licensed.
- Electrical runs on its own track. The state enforces the 2017 National Electrical Code through roughly 100 contracted deputy electrical inspectors under Chapter 0780-02-01, with its own list of exempt jurisdictions. Voting out of the building code leaves the electrical permit standing, and an off-grid power system is exactly the wiring an inspector will want to see.
- Water and septic are statewide. Anyone who drills, redrills or maintains a well — or installs a well pump, filter or closed-loop geothermal — must hold a TDEC license, and a general contractor's, plumber's or electrician's license doesn't substitute. Septic needs a TDEC construction permit before installation, with soil maps from a soil scientist and an engineered design for larger or alternative systems.

Tennessee Code Annotated § 68-120-101
This is the real off-grid gate in Tennessee, and it catches people who arrive expecting the Deep South rulebook. Section 68-120-101 is the statute behind the state's building construction safety standards, and the piece that matters on rural land is subsection (b)(1)(D): the provision under which counties and municipalities “may elect to exempt the county or municipality from the application of statewide standards for one-and two-family dwellings.” That election takes a two-thirds vote of the local legislative body. Where no such vote has happened and no local department has been approved to run its own program, the state code applies by default, with permits issued through the State Fire Marshal's Office and its contracted agents.
What the permit brings is a full inspection sequence: foundation before the pour, framing and rough-in, finished construction, plus plumbing and mechanical at rough-in and final for permits issued since October 1, 2011. The code enforced is the 2018 International Residential Code with the 2018 International Energy Conservation Code, adopted through Chapter 0780-02-23 of the Division of Fire Prevention's rules and covering one- and two-family dwellings and townhouses. Nothing in that scope turns on whether the house is connected to a utility — a solar-powered cabin on forty wooded acres is a one-family dwelling, and the structure, envelope and energy provisions land on it the way they land on a subdivision house.
The consequence people get wrong: reading “this county has no building department” as “this county has no code.” The state fills that gap by default, and a county with no office of its own may simply be a state-program county where an SFMO-contracted inspector shows up instead. The check to run before you buy is the SFMO's jurisdiction status list, current as of July 20, 2026, marking every county and city exempt, state-program or opted out. And the opt-out reaches the building code alone — the electrical permit, the TDEC septic permit and the licensed-driller rule sit outside § 68-120-101 and survive the vote.

What an Off-Grid Build Costs in Tennessee in 2026
Hardware is priced nationally — panels and batteries cost the same delivered to Cookeville as to Sacramento — so Tennessee's installed pricing sits inside the national band below. The Real Tennessee Angle: Storms Take the Wires Down, and the Land Bill Keeps Climbing
Tennessee's grid isn't fundamentally broken. What it is, repeatedly, is in the path of something. On March 3, 2020, an EF-3 tracked sixty miles from western Davidson County through East Nashville into Smith County while an EF-4 tore through Putnam County near Cookeville, killing twenty-four people between them — the deadliest tornadoes in the state since the April 27, 2011 outbreak. Nashville Electric Service had 50,124 customers off at the peak and 61,974 affected across a ten-day restoration that replaced nearly 1,000 poles and more than 450 transformers. On December 10 and 11, 2021, an EF-4 ran eighty miles out of Arkansas into Obion County and an EF-3 covered seventy-one miles from Newbern to Paris Landing; two TVA transmission towers came down near Lexington, and essentially all of Decatur County lost power for close to a week. On December 9, 2023, seven tornadoes hit Middle Tennessee, killing three around Clarksville and three in Sumner County. From September 25 to 29, 2024, Hurricane Helene's remnants delivered record rainfall and 40 to 60 mph winds to East Tennessee, with long-lasting outages behind them.
That's the case for a battery here, and it turns on duration more than frequency — a week without power in Decatur County is a different problem from an afternoon flicker. The economic case is moving faster. Tennessee farm real estate has gone from $4,290 an acre in 2021 to $6,150 in 2025, a 43% climb in four years, and pasture at $5,600 sells at nearly three times the national average because rural acreage here is priced by residential demand. The land that's still affordable is the land far from a pole, up a hollow or out on the plateau, which is exactly where a line extension quote turns into five figures.
Do I need a building permit for an off-grid home in Tennessee?
Usually yes, and that's the opposite of what people expect from a southern state. Title 69, Chapter 10 — a Tennessee general contractor, plumber or electrician license doesn't cover the work. Septic needs a TDEC construction permit before installation under T.C.A. §§ 68-221-401 through 414 and Rule 0400-48-01: $400 for a new conventional system up to 1,000 gallons a day, $500 for an alternative one.

Comfortably.
